O-88-09� ` 1 ORDINANCE NO. 0 -88 -09 AN ORDINANCE AUTHORIZING A SPECIAL USE IN THE C -2 OUTLYING COMMERCIAL DISTRICT Published in pamphlet form this 15th day of February , 1988, by the President and Board of Trustees of Deerfield. 4940S/30 I I ORDINANCE NO. 0 -88 -09 AN ORDINANCE AUTHORIZING A SPECIAL USE IN THE C -2 OUTLYING COMMERCIAL DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Amoco Oil Company (referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A hereto (the "Subject Property ") as a Special Use for an Automobile Service Station with an Automobile Convenience Food Shop, under and pursuant to the provisions of Articles 5.2 -3 and 13.11 of the Zoning Ordinance of the Village of Deerfield as hereinafter more particularly described on the Subject Property; and WHEREAS, the Zoning Board of Appeals has conducted a public hearing pursuant to notice duly published according to statute on Applicants petition for a variation from the strict provisions of Article 5.2 -6,3 establishing minimum yard requirements all in accordance with Exhibit B as more particularly described below; and WHEREAS, each of said hearings was held pursuant to duly published notice-thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of both the Zoning Board of Appeals and the Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the Revised final Development Plan consisting of the Site Plan dated January,8�, 1988, the Sign Plan dated January 6, 1988 each prepared by Applicant and the Landscaping Plan dated January 9, 1988 prepared by Penco Associates (collectively the "Final Development Plan "); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use and certain specific variations in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: ORDINANCE NO. 0 -88 -09 AN ORDINANCE AUTHORIZING A SPECIAL USE IN.THE C -2 OUTLYING COMMERCIAL DISTRICT SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 5.2 -3 and 13.11 of the Zoning Ordinance, and the Special Use of the real estate, as and for purposes of an Automobile Service Station with an Automobile Convenience Food Shop as set forth on Exhibit B subject to certain conditions and the granting of certain variations as more particularly set forth on Exhibit B and the same are hereby authorized and approved. SECTION That the approval and authorization of said Special TWO: Use hereby granted is subject to the following conditions: That all use, construction and development shall be in accordance with the submitted Final Development Plans, a copy of which is included and made a part hereof, all other documentary and exhibit filings made pursuant to the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Zoning Board of Appeals, the Plan Commission and President and Board of Trustees. SECTION That the President and Board of Trustees do hereby THREE: grant and authorize the following variation: (A) Minimum yard requirements are permitted as in accordance with and as depicted on the Final Development Plan marked and attached as Exhibit B. SECTION That the Special Use hereby authorized shall be FOUR: binding upon and inure to the benefit of Applicant's successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Final Site Plan" in the ofice of the Recorder of Deeds of Lake County, Illinois at Applicant's expense.
