O-89-07ORDINANCE NO. 0 -89 -07 AN ORDINANCE GRANTING MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 111 PFINGSTEN ROAD, DEERFIELD, ILLINOIS Published in pamphlet form this 6th day of February , 1989, by the President and Board of Trustees of Deerfield. 562351010989 ORDINANCE NO. 0 -89 -07 AN ORDINANCE GRANTING MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 111 PFINGSTEN ROAD, DEERFIELD, ILLINOIS WHEREAS, the Lincoln Property Company ( "Petitioner ") has petitioned for a modification from the strict provisions of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 7, 1978, as amended, to permit the continued display of the existing real estate sign in lieu of the permitted 20 square feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation denying Petitioner's request. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the ONE: Zoning Board of Appeals recommending denial of the petition are not adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find that in TWO: view of the unusual configuration of and elevations existing on Petitioner's property that unnecessary or undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described on Exhibit A attached hereto and made a part hereof. SECTION That a modification from the strict provisions of THREE: Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit the display of the following sign: A. non- illuminated double -faced sign up to 50 square feet in size per face, to be permitted for a period not to exceed 12 months at a location approximately 120 feet northwest of the entrance to Petitioner's improvement and approximately 40 feet east of the west property line all as depicted on Exhibit B attached hereto and made a part hereof. SECTION That this ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
