Cromie Deputy Village Clerk I 5 562351060889/53 ORDINANCE NO. 0 -89 -32 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE WOODLAND PARK SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Board of Education of School District 109 and Deerfield Park District (herein collectively the "Petitioner ") to authorize an amendment to the existing Special Use of Woodland Park School, Deerfield, Illinois to approve the extension of the existing Special Use for the Riverside Foundation and the extension of the sublease of a portion of the Woodland Park School to the Center for Enriched Living, all in accordance with Articles 7.2 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, made written findings of fact, including express affirmative findings of compliance with the provisions of Articles 7.2 and 13.11 of the Village Zoning Ordinance and recommended that said Amendment to Special Use of said real estate be approved and authorized in accordance with the plans presented and the testimony adduced by the Petitioner at said hearing subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof, be and the same, is hereby authorized and approved. SECTION That the approval and authorization of said Amendment TWO: to Special Use to extend the term of the Special Use to Riverside Foundation only and not to any successors and assigns for a period not to exceed ten (10) years and to approve the sublease of a portion of the Woodland Park School to the Center for Enriched Living for a period not to exceed ten (10) years, all in accordance with Articles 7.2 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended, is hereby given subject to the requirements that all use shall be in accordance with all exhibits, testimony, and representations submitted and made by the.Petitioner to the Plan Commission and the President and Board of Trustees, and is also subject to compliance by Petitioner with all other applicable provisions of the Zoning Ordinance. 2820159 3 ORDINANCE NO. 0 -89 -32 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE WOODLAND PARK SCHOOL SECTION That any violation of any of the conditions THREE: hereinabove set forth by the Petitioner or its successors, grantees, transferees or assigns, shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION: That all approval and authorization of said Amendment FOUR: to Special Use is hereby given subject to the requirements that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Petitioner. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form. SECTION That except to the extent specifically amended hereby, SIX: all provisions of Ordinances No. 86 -24 and 87 -45 shall remain in full force and effect and all undertakings of the Petitioner or its successors, grantees, transferees or assigns shall remain in full force and effect as if fully restated herein.
