O-89-351, a� 56235/78' l r ORDINANCE NO. 0 -89 -35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE WITH RESPECT TO THE WHITEHALL NURSING HOME PROPERTY COMMONLY KNOWN AS 300 WAUKEGAN ROAD, DEERFIELD, ILLINOIS Published in pamphlet form this 7th day of August , 1989, by the President and Board of Trustees of Deerfield. 562352071989/76 ORDINANCE NO. 0 -89 -35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE WITH RESPECT TO THE WHITEHALL NURSING HOME'PROPERTY COMMONLY KNOWN AS 300 WAUKEGAN ROAD, DEERFIELD, ILLINOIS WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of WHITEHALL NORTH CONVALESCENT HOME PARTNERSHIP ( "Applicant ") to authorize an amendment to a Special Use of certain real estate commonly known as 300 Waukegan Road, Deerfield,.Illinois, and hereinafter described, for an expansion to the Nursing Home, as hereinafter described, under and pursuant to the provisions of Articles 5.2 and 13.11 -4 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, pursuant to Ordinance 72 -70 and as thereafter amended by Ordinances, 76 -67 and 86 -46, the Village of Deerfield had previously permitted a Special Use allowing the use of a portion of the real estate for a nursing home. WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact including express affirmative findings of compliance with the provisions of Article 5.2 and 13.11 -4 of the Village of Zoning Ordinance and recommended that said amendment for Special Use of said real estate be approved and authorized in accordance with the Site Plan prepared by Shayman & Salk Co., Architects, dated April 20, 1989, attached hereto as Exhibit A and made a part hereof, and the testimony adduced by the Applicant at said hearing and subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the amendment to Special Use of Lots 1 and 2 in Golf -View subdivision, being a Subdivision of part.of the Southwest quarter of Section 33, Township 43 North, Range 12, East of the Third Principal Meridian, all in the Village of Deerfield, recorded April 1, 1977, as document number 1827850, Plat Book 59, Page 8, as and for an expansion to the Nursing Home, in accordance with the Site Plan, as hereinabove described, subject to the conditions and restrictions hereinafter set forth, be and the same is hereby authorized and approved. ORDINANCE NO. 0 -89 -35 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE WITH RESPECT TO THE WHITEHALL NURSING HOME PROPERTY COMMONLY KNOWN AS 300 WAUKEGAN ROAD, DEERFIELD, ILLINOIS SECTION That the approval and authorization of said Amendment TWO: to Special Use hereby authorized is subject to compliance by Applicant with all other applicable ordinances of the Village of Deerfield and is subject to the following further conditions: A. That the addition to the existing nursing home facility at the southeast corner of the building shall not exceed 5 additional bedrooms per each of 2 floors and not exceed 10 additional beds. B. That the addition to the Kitchen facility on the west side of the building consist of 816 square feet and be one -story in height. SECTION That the approval and authorization of said Amendment THREE: to Special Use hereby authorized is subject to the requirement that this Ordinance and Exhibit A hereto shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That all ordinances or parts of ordinances in conflict FOUR: herewith are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law.
