O-89-36t ORDINANCE NO. 0 -89 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this ^ -7:7th day of August , 1989, by the President and Board of Trustees of Deerfield. 562352092989/66 ORDINANCE NO. 0 -89 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission;of the Village of Deerfield has heretofore held a public hearing on the application of Kitchens of Sara Lee and Deerfield State Bank (collectively, the "Petitioner ") to consider certain text amendments to the Zoning Ordinance of the Village of Deerfield relative to permitting the installation of an automatic teller machine drive -thru facility in an I -2 Limited Industrial Zoning District as a Special Use upon certain conditions and in certain circumstances; and WHEREAS, said heaing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended text amendments to the Zoning Ordinance of the Village of Deerfield to achieve the objectives sought by the Petitioner; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendations of the Plan Commission as to the proposed text amendments will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article 6, Section 6.2 -3 of the Zoning Ordinance ONE: of the Village of Deerfield, as amended, be and the same is further amended by adding thereto the following subsection 4c: "c. Automatic Teller Machine drive -thru facilities, provided such use'is developed as a part of an Industrial Planned Unit Development of a minimum of 40 acres and further provided that a stacking lane to accommodate not less than six vehicles is provided." SECTION That Article 9, of the Zoning Ordinance of the Village TWO: of Deerfield, as amended, be and the same is further amended by adding thereto the following subsection 9.2 -4,5: ORDINANCE NO. 0 -89 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD "5. Signs Accessory to Freestanding Automatic Teller Machines (ATM) a. Business Ground Sign Additional lettering /signage panel may be added to one.permitted Planned Unit Development ground sign, which signs are provided for in Article 9.2. Such additional signage shall not exceed three and one -half (3.5) square feet in area as measured by circumscribing a rectangle around the lettering or by measuring the overall dimensions of the signage panel. b. Signage on the ATM Kiosk 1) Front of Kiosk On the front and rear of the kiosk one overhead sign panel is permitted. The panel shall be no larger than two (2) feet in height and eleven and one -half (11.5) feet in length including the frame in which the sign panel is mounted. The panel may be illuminated. The sign panel may not extend above the top of the kiosk. 2) Sides of Kiosk One overhead sign panel is permitted on each side of the kiosk. Each sign panel may be no larger than two (2) feet in height and six feet seven inches in length including the frame in which the sign panel is mounted. The sign panels may be illuminated. The sign panels may not extend above the top of the kiosk. ORDINANCE NO. 0 -89 -36 AN ORDINANCE AMENDING PORTIONS OF ARTICLES 6 AND 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD 3) Miscellaneous Signage Any instructional or regulatory signage necessary for the operation of _the ATM is exempt from the provisions of this Ordinance." SECTION That the Village Clerk is hereby directed to publish THREE: this Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict FOUR: herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
