O-89-37/ 5623S/72 ORDINANCE NO. 0 -89 -37 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE KITCHENS OF SARA LEE Published in pamphlet form this 7th day of August , 1989, by the President and Board of Trustees of Deerfield. 562352071089/70 ORDINANCE NO. 0 -89 -37 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR THE KITCHENS OF SARA LEE WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Kitchens of Sara Lee and Deerfield State Bank (hereinafter the "Petitioners ".) to authorize an amendment to the existing Special Use of the Kitchens of Sara Lee to approve the installation of an automatic teller machine drive -thru facility, all in accordance with Articles 6.2 -3, 9.2 -4,5 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced, the submitted site plan, design, and signage plan prepared respectively by Robert Frager Associates Architects /Planners, dated March 20, 1989, Dallman Industrial Corp., dated May 4, 1989, and North Shore Signs (collectively, the "Final Site Plan "), made written findings of fact and recommended that said Amendment to Special Use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission approving the Final Site Plan described above are concurred in and adopted as the findings of the President and Board of Trustees and the Amendment to Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof to approve the installation of an automatic teller machine drive -thru facility, be and the same, is hereby authorized and approved. SECTION That the approval and authorization of said amended to TWO: to Special Use is hereby given subject to the requirements that all use shall be in accordance with all exhibits, testimony, representations submitted and made by the Petitioners to the Plan Commission and President and Board of Trustees and is also subject to compliance by Petitioners with all other applicable provisions of the Zoning'Ordinance. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law.
