O-87-65ORDINANCE NO. 0 -87 -65 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT Published in pamphlet form this 21st day of December , 1987, by the President and Board of Trustees of Deerfield. 0501J/34 ' I ORDINANCE NO. 0 -87 -65 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of TRAMMEL CROW CORPORATION to authorize an Amendment to Ordinance No. 0 -86 -50 to provide for the development and use of certain real estate described on Exhibit A hereto for a Special Use - Planned Unit Development, under and pursuant to,the provisions of Articles 6.1 -3, 5, 12.1, 12.8 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewedthe Amended Final Development Plan for the Subject Property consisting of the Signage Plan for Crosscreek Phase One prepared by Serena -Sturm Architects, Ltd., dated October 14, 1987 ( "Signage Plan ") submitted by Applicant to the Plan Commission ref.lecting all signage which had not been submitted as part of the original Final Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Amendment to Special Use - Industrial Planned Unit Development in accordance with the Signage Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find the Amended Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 13.11 -4 of the Village Zoning Ordinance, and the Amended Special Use of the real estate, as and for purposes of an Industrial Planned Unit Development as set forth on Exhibit B, be and the same is, hereby authorized and approved. ORDINANCE NO. 0 -87 -65 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT SECTION That the approval and authorization of said Amendment TWO: to Special Use of the Subject Property as and for office uses, as more specifically described below and as hereby granted is subject to the following conditions: (a) That all use, construction and development shall be in accordance with the Amended Final Development Plan of the Subject Property consisting of the Signage Plan submitted by Applicant to the Plan Commission, a copy of which is included and marked as Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Planned Unit Development Procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations made by the Applicant to the Plan Commission and President and Board of Trustees. (b) That the two -sided temporary sign depicted on Exhibit B shall be approved subject to the following conditions: 1. A maximum area of 10' x 10' per sign face shall be permitted. 2. The maximum angle between the two sign faces shall be limited to 30 degrees. 3. The sign may be illuminated from the ground, but such lighting shall automatically be turned off no later than 10:00 p.m. 4. The sign shall be removed no later than two years from the date of passage hereof. 5. The sign shall be located no closer than 100' from Lake Cook and Pfingsten Roads as measured from the respective curb lines rather than the property lines. It is understood that the exact location of the sign cannot be presently determined and may change as the various engineering /highway projects currently underway or planned proceed over the two year period. SECTION That any violation of any of the conditions hereinabove THREE: set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amended Special Use hereby authorized. ORDINANCE NO. 0 -87 -65 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form and to record said Ordinance and Exhibit B in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That except to the extent specifically amended hereby, FIVE: all provisions of Ordinance No. 0 -86 -50 shall remain in full force and effect and all undertakings of the Applicant or its successors, shall remain in full force and effect as if fully restated herein. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication as provided by law.
