ORDINANCE NO. 0 -87 -28 AN ORDINANCE AUTHORIZING A SPECIAL USE HEALTH CLUB FACILITY Published in pamphlet form this t, day of July 1987, by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -87 -28 AN ORDINANCE AUTHORIZING A SPECIAL USE HEALTH CLUB FACILITY WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of 1717 Deerfield Road Limited Partnership, an Illinois Limited Partnership (the "Owner "), and Premark International, Inc. (the "Developer ") (the Owner and Developer are hereinafter referred to as "Applicant ") to authorize a Special Use to provide for the development and use of certain real estate described on Exhibit A hereto for a Special Use as a Health Club Facility, under and pursuant -to the provisions of Articles 6.1 -3, 4a, and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Applicant has also requested that the Annexation Agreement, as amended, between the Village and the Owner be further amended to permit the Special Use as hereinafter described. WHEREAS, said hearing was heid'pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Final Development Plan for the Subject Property consisting of plans for the inclusion of an approximately 2400 square foot health club facility which is to be used by the employees of Developer and as depicted on the Final Development Plan dated June 2, 1987 prepared by Ferry- Hayes, Designers, Inc.; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use in accordance with the plans for an addition of an approximately 2400 square foot health club facility which is to be used by employees of Developer, subject to "the requirements that all use shall be in accordance with all Exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance and continued compliance with the terms and provisions of the Annexation Agreement, as amended. ORDINANCE NO. 0 -87 -28 NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees ONE: do hereby affirmatively find the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Article 13.11 -4 of the Village Zoning Ordinance, and the Special Use for an approximately 2400 square foot health club facility which is to be used by the Developer's employees, be and the same is, hereby authorized and approved subject to the requirements that all use shall be in accordance with all Exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance and the Annexation Agreement, as amended. SECTION That the approval and authorization of said TWO: Amendment to Special Use of the Subject as and for an approximately 2400 square foot health club facility which is to be used by the Developer's employers is hereby granted subject to the condition that the Amendment to Annexation Agreement between the Village and the Owner permitting such Special Use be executed. SECTION That any violation of any of the conditions THREE hereinabove set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Vill-age Clerk is hereby directed. FOUR to publish this Ordinance in pamphlet form and to record said Ordinance in the Office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. ORDINANCE NO. 0 -87 -28 SECTION That except to the extent specifically amended FIVE: hereby, all provisions of the Annexation Agreement shall remain in full force and effect and all undertakings of the Owner or its successors, shall remain in full force and effect as if fully restated herein.
