Dated this •' ,,1tc,`,%�,. , c �Y' . `ire., S � .';! ; L� ,ate�t �� MA ?Qe� E EMERY f ��, �}}T,jj� Deputy Village C1er ORDINANCE NO. 0 -87 -36 AN ORDINANCE APPROVING A SPECIAL.USE IN P -1 PUBLIC LANDS DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Village of Deerfield Park District (herein referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A attached hereto and located north of Deerfield Road and the east side of the Tri -State Tollway and zoned in the P -1 Public Lands District ( "Subject Property "), for a Special Use to permit the installation of a light structure on Diamond 12 at Clavey Park, in accordance with the applicable provisions of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission has recommended approval of said application; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use in accordance with the plans and exhibits presented by Applicant and marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in the applicable provisions of the Village Zoning Ordinance, and the Special Use of the real estate, as and for the purposes of the installation of a light structure on Diamond 12 at Clavey Park as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of the Special Use TWO: hereby granted is.subject to the following conditions: 1. That all use, construction and development of the Subject Property shall be in accordance with a certain Clavey School Park Lighting Plan, dated June 9, 1987, prepared and submitted by Applicant, marked Exhibit B attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to the Special Use provisions of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. 2614 57 ORDINANCE NO. 0 -87 -36 AN ORDINANCE APPROVING A SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT 2. That the existing lights on Diamond 10 shall be re -aimed to a position that will reduce the glare and lighting spill on surrounding properties. In addition, Applicant, at its own expense, shall louver and visor as necessary the lights on Diamond 10 which produce glare and spill following such re- aiming in accordance with the recommendations of Applicant's lighting expert. All of such re- aiming and louvering.shall be completed prior to the Fall of 1987. 3. Applicant shall apply a portion of the $10,000.00 budgeted.for remedial work on Clavey Park for the fiscal year 1987 to re- aiming and louvering of the lights as aforesaid.. The remainder of these funds shall be spend in oandscaping the eastern and northern boundaries of Clavey Park and the Applicant shall provide, at the request of the Village, a receipt evidencing the amount of money paid for such re- aiming and louvering. At a minimum, the Applicant shall purchase at least ten (10) four and a half ((4h) caliper green ash trees at a height of approximately twenty -five (25) feet. Prior to the placement of these trees, the Applicant shall seek and consider the wishes of all of the adjacent property owners in deciding the placement of'the trees. The trees shall be planted as soon as possible, but in any event, prior to October 15, 1987. 4. Applicant shall place automatic timers on the lights on Diamond 10 and Diamond 12. Applicant shall require of its users that no innings shall begin on Diamond 10 or Diamond 12 after 10:30 P.M. All lights other than security lights shall be extinguished by 11:00 P.M. In any event, all except security lights shall be manually turned off prior to 11:00 P.M. upon the completion of the games on each diamond. 5. Applicant shall prohibit and enforce the restrictions as to the use of any loudspeakers or sound amplification devices on Diamond 12 when the lights are in use. 6. Applicant shall continue to maintain two portable lavatories at their present location at Clavey Park. 7. Applicant shall agree to a stipulation in the settlement of the existing litigation providing that the Applicant will not erect permanent seating for Diamonds 10 or 12 or a permanent concession stand in Clavey Park, without prior written notice to each of the named plaintiffs in the aforementioned litigation. This public hearing shall be in addition to any public hearings required by Village Ordinances. 8. Applicant shall provide informational material to the captains of each softball team at each pre- season organizational meeting informing them of the parking require- ments at Clavey Park, including the requirement that (1) softball participants are prohibited from parking along King Richards Court, Chatham Circle, Pear Tree Court, Montgomery Drive, or any other side streets; and (2) such participants are to park in the parking lot on the south side of Clavey Park. 9. Applicant shall provide additional landscaping in Clavey Park according to the following schedule: Applicant shall expend the sum of $5,000.00 for additional landscaping along the north and eastern boundaries of Clavey Field in fiscal year 1988. Such landscaping shall be installed prior to May 1, 1988. Applicant shall expend $5,000.00 for additional landscaping along the north and eastern boundaries of Clavey Park in fiscal year 1989. Such landscaping shall be installed prior to May 1, 1989. 10. In the event any trees planted by the Applicant in 1987, 1988 or 1989 shall die, the Applicant shall replace said trees at its expense. The replacement cost of these trees shall be in addition to any other expenditures required hereby. 11. Applicant shall provide directional parking signs at the Montgomery Road entrance to the Wilmot Junior High School property, advising motorists of the availability of parking to the west of the school building and such additional signs on site as are needed to assist motorists in locating that parking facility. SECTION That any violation of any of the conditions THREE: hereinabove set forth shall authorize the revocation of the Special Use hereby authorized.
