O-87-42ORDINANCE NO. 0 -81- 42 AN ORDINANCE AUTHORIZING A SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Scott Greenberg and Gerald Greenberg D /B /A E. C. D. Company, and LaSalle National Bank as Trustee under Trust No. 104882 (referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A hereto (the "Subject Property ") as a Special Use Planned Unit Development, under and pursuant to the provisions of Articles 6.2 -3, 12.1, 12.8, 12.9 and 13.11 of the Zoning Ordinance of the Village of Deerfield for a Flex Tech Office Building and a Self- Storage Facility as hereinafter more particularly described on the Subject Property and.to authorize the approval of certain variations from Article 12.8 and other provisions of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the submitted Site Plan dated June 25, 1987 prepared by Richard Preves b Associates, and the Final Landscaping Plan prepared by Camiros, Ltd., dated June 3, 1987 (collectively the "Final Development Plan "), and the sign plans prepared by Doyle Sign Company, consisting of four sheets and dated June 12, 1987 (sign A); June 17, 1987 (signs B and C) and July 24, 1987 (sign D); and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use Planned Unit Development and certain specific variations in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Special Use as hereby authorized, fully complies with the requirements and standards set forth in Articles 6.2 -3, 12.1 , 12.8 and 13.11 of the Zoning Ordinance,'and the Special Use of the real estate, as and for purposes of a Planned Unit Development as set forth on Exhibit B subject to certain conditions and the granting of certain variations as more particularly set forth on Exhibit B subject to certain conditions and the granting of certain variations as more particularly set forth below, be and the same are hereby authorized and approved. SECTION That the approval and authorization of said.Special Use hereby TWO: granted is subject to the following conditions: ORDINANCE NO. 0 -87- 42 AN ORDINANCE AUTHORIZING A SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT (A) That all use, construction and development shall be in accordance with the submitted Site Plan dated June 25, 1987 and prepared by Richard Preves & Associates, and the Final Landscaping Plan prepared by Camiros, Ltd., and dated June 3, 1987 and the Sign Plans prepared by Doyle Sign Company, consisting of four sheets and dated June 12, 1987 (sign A), June 17, 1987 (signs B and C) and July 24, 1987 (sign D), (collectively the "Final Development Plan "), a copy of which is included and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 -6 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. (B) That no outside storage shall be permitted on the real estate. (c) Water and sewer facilities located upon the property within the landfill area shall be installed in accordance with generally accepted engineering standards and practices. Maintenance thereof shall be the responsibility of the property owner. (D) The applicant shall provide evidence to the Village Engineer ( or to Village retained consultants) which is sufficient to demonstrate that the construction methods contemplated are reasonably safe and appropriate * in the presence of possible methane gas. SECTION That the President and Board of Trustees do hereby grant THREE: and authorize the following variations: (A) Yard are permitted as follows: 40 foot west side yard; 25 foot.north rear yard; 40 foot east side yard; 35 foot south side yard. (B) Parking within front yard and south side yard setbacks is authorized. (C) Sign variations in accordance with Sign Plan. (D) Waiver of the requirement of wheel stops. -2- *(E) That the authority to maintain "sign D" shall terminate eighteen (18) months after the issuance of the first certificate of occupancy upon the property. ORDINANCE NO. 0 -87 -42 AN ORDINANCE AUTHORIZING A SPECIAL USE INDUSTRIAL PLANNED UNIT DEVELOPMENT SECTION That the Special Use hereby authorized shall be binding FOUR. upon and inure to the benefit of Applicant's successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by theApplicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this Ff1TE: Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Final Site Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense.
