ORDINANCE NO. 0 -87 -44
AN ORDINANCE FOR THE CONDEMNATION OF LAND
FOR THE EXPANSION, IMPROVEMENT AND MAINTENANCE
OF A PUBLIC STREET AND OTHER PUBLIC PURPOSES
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That it is necessary and in the best interest of the
ONE: Village that the Village acquire title to and possession
of the real property described on Exhibit A hereto, which
said real property is necessary, required and needed for the expansion,
improvement and maintenance of a public street and other public purposes.
SECTION That Robert Franz, Village Manager, and James K. Stucko,
TWO: Village Attorney, be and they are hereby authorized,
empowered and directed for and on behalf of the Village
of Deerfield to negotiate with the owner or owners of the real estate
hereinabove described for the purchase thereof by the Village.
SECTION That in the event the said Village Manager and Village
THREE: Attorney are unable to agree with the owner or owners of
said real estate upon the compensation to be paid
therefor, then title and possession of said real estates, as described
aforesaid, shall be acquired by the Village, and James K. Stucko, as
attorney for the Village, is hereby authorized, empowered and directed
to institute proceedings in any court of competent jurisdiction to
acquire title to and possession of said real estate for the Village in
accordance with the eminent domain laws of the State of Illinois.
SECTION That this Ordinance shall be in full force and effect
FOUR: from and after its passage and approval, as provided by
law.

as follows: Commencing at the point of intersection of the south right -of -way
line of Deerfield Road and the westerly right -of -way line of Waukegan Road;
thence southerly along said westerly line of Waukegan Road 75.23 feet; thence
south 760 48' west 60.00 feet; thence southerly parallel with said westerly line
of Waukegan Road 5.0 feet; thence south 760 48' west 80.76 feet; thence north
110 10' west 113.03 feet, more or less, to said south line of Deerfield Road,
thence east along said south line of Deerfield Road 143.50 feet, more or less,
to the point of beginning, all in the Village of Deerfield, County of Lake, State
