ORDINANCE NO. 2023- 0-23-29
AN ORDINANCE AMENDING SECTION 15-16 OF "THE MUNICIPAL CODE OF
THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED,
REGARDING SNOW REMOVAL ACTIVITIES
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, Section 15-16 of "The Municipal Code of the Village of Deerfield, Illinois,
1975," as amended ("Village Code') generally prohibits people from making loud, raucous
or jarring noise which either annoys, disturbs, injures, or endangers the comfort, repose,
convenience, health, peace, or safety of persons ("Noise Regulations'); and
WHEREAS, it is important to allow individuals and businesses to engage in snow
removal activities, including conducting those activities at night, to allow for safe and easy
passage of emergency vehicles, residents getting to and coming from their places of
employment, and students getting to and coming from school; and
WHERAS, the Village Board desires to amend the Noise Regulations to clarify that
the Noise Regulations do not prohibit snow removal activities; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interests of the Village and its residents to amend Section 15-16 of the Village Code pursuant
to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: AMENDMENT TO SECTION 15-16 OF THE VILLAGE
CODE. Pursuant to the Village's home rule authority, Article 1, titled, "Offenses Against
Public Peace, Safety and Order," of Chapter 15, titled, "Morals and Conduct," of the Village
Code is hereby amended further to read as follows:
"Sec. 15-16. Noise:
(a) No person shall make, continue, or cause to be made or continued, any
loud, raucous or jarring noise which either annoys, disturbs, injures, or
endangers the comfort, repose, convenience, health, peace, or safety of
persons, within the area of audibility.

(c) This Section does -not apply to, or prohibit, snow plowing, snow
blowing, or other snow removal activities, regar-d.less of when
those activities are performed."
SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and publication in the manner provided by law.
