O-23-28VILLAGE OF DEERFIELD ORDINANCE NO. 2023- 0-23-28 AN ORDINANCE AMENDING CHAPTER 22 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, REGARDING STANDING VEHICLES WEIGHING MORE THAN 10,000 POUNDS WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, Article 13 of Chapter 22 of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code'), provides miscellaneous laws related to vehicles and traffic; and WHEREAS, large vehicles that stand with their engines running for prolonged periods of time create air and noise pollution, obstruct traffic, as well as may create other nuisances; and WHEREAS, the Village Board desires to prohibit vehicles weighing more than 10,000 pounds from standing with their engines running for than more 10 minutes anywhere in the Village, subject to limited exceptions; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend Article 13 of Chapter 22 of the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: PROHIBITION ON STANDING WITH ENGINE RUNNING. Pursuant to the Village's home rule authority, Article 13, titled "Miscellaneous Laws," of Chapter 22, titled "Vehicles and Traffic," of the Village Code is hereby amended to add a new Section 22-105D, which shall be and read as follows: "Sec. 22-105D. SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and publication in the manner provided by law.
