O-23-27VILLAGE OF DEERFIELD ORDINANCE NO. 2023- 0-23-27 AN ORDINANCE AMENDING SECTIONS 6-1 AND 6-10 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, REGARDING WORK WITHOUT A VALID PERMIT WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, Section 6-1 of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code'), requires a building permit for certain plumbing, electrical, roofing, and construction work ("Building Permit'); and WHEREAS, Section 6-10 of the Village Code requires a demolition permit for certain demolition work ("Demolition Permit'); and WHEREAS, the Village Board desires to make clear that it is a violation of the Village Code to perform work or demolition requiring a Building Permit or Demolition permit while displaying an invalid permit; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend Sections 6-1 and 6-10 of the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: BUILDING PERMIT REQUIRED. Pursuant to the Village's home rule authority, Section 6-1, titled "Permit Required," of Article 1, titled "In General," of Chapter 6, titled "Building," of the Title titled, "Building," of the Village Code is hereby amended further to read as follows: "Sec 6-1. Permit Required: a. A building permit shall be required for all plumbing, electrical and roofing work except as specifically provided in this chapter; chapter 8, "Electricity"; chapter 16, "Plumbing And Sewers", of this Code, and for all construction or improvement work when such work is regulated by the provisions of the Village Building Codes. Notwithstanding anything to the contrary contained in this Section or any other section of this Code or the Village Building Codes, a permit is not required for the following types of work provided that the work does not include (1) changes to, or the installation of, plumbing or electric conduit, electrical boxes, or electric wiring; (ii) the cutting away or removal of any portion of an exterior wall, interior wall, partition, floor or roof, (Ili) the removal Additions are bold_ and double -underlined-, -deletions are sti-uek "--aia� 1 4881-1794-6234, v. 2 or cutting away of any structural beam, column or load -bearing support; or (iv) the removal or change of any required means of egress or rearrangement of parts of a structure affecting the egress requirements: (1) Painting, wallpapering, floor tile, floor coverings, carpeting, countertops, the installation of shelving or cabinets, and similar finish work; (2) Repairs or replacement of a singular plumbing fixture where no modification or extension of any other plumbing is required, and provided that other work is being performed; (3) Repairs to an elevator, dumbwaiter, or other conveyance device involving the replacement of existing parts with replacement parts that are identical to those that are replaced, provided a written log of such repairs must be maintained by the owner and made available to the building official upon request; (4) Repair or in -kind replacement of ceiling fans, light fixtures, electric outlets, and light switches, provided that such repair or replacement is not done in conjunction with any other work; (5) Repair or in -kind replacement of windows; (6) Repair or in -kind replacement of interior or exterior doors; (7) Repair or in -kind replacement of exterior wood, vinyl, aluminum, fiber -cement, stucco or EIFS siding; (8) Repair or in -kind replacement of a hot water heater; (9) Repair or in -kind replacement of a furnace; (10) Repair or in -kind replacement of air-conditioning equipment; (11) Repair or in -kind replacement of no more than 50 square feet of masonry. Work may not be divided up into phases for the purpose avoiding the need to obtain a building permit. Any violation of this Section 6-1.a shall be an offense punishable by a fine equal to 100 percent of the base building permit fee, with a minimum fee of no less than $300.00 and a maximum fee of no more than $1,000.00, per violation. Each day on which a violation of this section occurs or continues shall constitute a separate violation. b. Pursuant to the Village's home rule authority, Section 6-10, titled "Demolition Permits; Site Restoration; Time Limits," of Article 1, titled "In General," of Chapter 6, titled "Building," of the Title titled, "Building," of the Village Code is hereby amended further to read as follows: "Sec 6-10. Demolition Permits; Site Restoration; Time Limits: (a) Except as provided in subsection (b) of this section, demolition permits for all habitable structures shall be issued for a period of time reasonably necessary, as determined by the Director of Building and Zoning, for contractor mobilization, demolition of the structure and clearing the site and (if applicable) filling of the excavation, including the institution of appropriate measures by the applicant for protection of the health, safety and welfare of the public, contiguous property owners and persons engaged in performing the demolition work, but in no event for a period of time in excess of six (6) months. (b) A demolition permit issued for a single-family residence shall be valid for forty two (42) days. (c) A stormwater drainage plan shall be required in accordance with article 10 of this chapter as a condition for the issuance of a demolition permit for any site. If a building permit is issued for construction of a new single- family residence at the same time as a permit for demolition of an existing single-family residence on the same zoning lot, the stormwater drainage plan shall show the proposed conditions and drainage patterns after completion of the new construction. (d) Upon completion of the demolition in accordance with the terms and conditions of the permit, the applicant and lot owner shall cause the site to be restored in accordance with the terms and conditions of the permit prior to expiration of the permit. All demolition debris and refuse shall be properly disposed of outside the corporate limits of the Village in accordance with all applicable environmental laws and regulations. (e) If substantial construction of a new principal structure has not commenced within twenty eight (28) days of expiration of the demolition permit, the applicant and lot owner shall cause the site to be restored not later than fourteen (14) days thereafter. Restoration of the site shall include permanent disconnection of sewer and water services at the respective mains; removal and proper disposal of all rubbish and debris; removal of all tree and protective fencing; restoration of all damaged public property; restoration of any damage to adjacent properties; and final grading and seeding of the site in accordance with an approved stormwater drainage plan. If weather does not allow final grading and seeding to be completed, the Director of Building and Zoning may allow rough grading of the site and necessary erosion control measures until weather conditions permit final grading and seeding. f. SECTION FOUR: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FIVE: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after the later of: (i) its passage and approval in the manner provided by law; and (ii) October 20, 2023.
