O-87-49ORDINANCE NO. 0 -87 -49 AN ORDINANCE AMENDING A SPECIAL USE - CHILI'S RESTAURANT - LAKE COOK PLAZA SHOPPING CENTER Published in pamphlet form this 6th day of October , 1987 by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -87 -49 AN ORDINANCE AMENDING A SPECIAL USE - CHILI'S RESTAURANT - LAKE COOK PLAZA SHOPPING CENTER WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Lake Cook Plaza Shopping Center and Chili's Restaurant (hereinafter, collectively the "Applicant ") to amend the Special Use previously granted by Ordinance No. 86 -63 to permit the construction of a Chili's Restaurant in lieu of a previously approved Bay Street Restaurant as an Amendment to Special Use - Planned Unit Development of Lake Cook Plaza Final Development Plan, all in accordance with Articles 2.0 -3, 2, 5.2 -3, 1,8, 12.5 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, Applicant has requested that the Plan Commission and the Board of Trustees of the Village of Deerfield find that Applicant's Chili's Bar & Grill Site Plan, Chili's Prototype 5AX Floor Plan, and Elevation Plan, each prepared by the Vincent Association and Architects (collectively, the "Chili's Restaurant Plans "), are in substantial conformance to the Bay Street Restaurant Site Plan, Landscape Plan and Seating Plan ( "Bay Street Restaurant Plans ") previously approved as an Amendment to Special Use of said real estate, pursuant to Ordinance No. 86 -63; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence,',: adduced, the submitted Chili's Restaurant Plans, made written findings of fact and recommended that Applicant's Chili's Restaurant Plans be found to be in substantial conformance to the Bay Street Restaurant Plans previously approved as an Amendment to Special Use of said real estate subject to certain conditions and restrictions hereinafter set forth; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission of the submitted Chili's Bar & Grill Site Plan, Chili's Prototype 5AX, and Elevation Plan, each prepared by the Vincent Association and Architects, are concurred in and adopted as the findings of the President and Board of Trustees and the Chili's Restaurant Plans are found to be in substantial conformance to the Bay Street Restaurant Site Plan, Landscape Plan and Seating Plan previously approved as an Amendment to Special Use of the real estate legally described in Exhibit A attached ORDINANCE NO. 0 -87 -49 AN ORDINANCE AMENDING A SPECIAL USE - CHILI'S RESTAURANT - LAKE COOK PLAZA SHOPPING CENTER hereto and made a part hereof, and Ordinance No. 86 -63 i's hereby amended to reflect said findings and recommendations. SECTION That the findings of substantial conformance of TWO: Chili's Restaurant Plans to the Bay Street Restaurant Plans as submitted as an Amendment to Ordinance No. 86 -63 Special Use is hereby approved subject to the requirements that all use shall be in accordance with all exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance. SECTION That any violation of any of the conditions THREE: hereinabove set forth shall authorize the revocation of the Special Use permit for Chili's Restaurant Plans. SECTION That the granting of the Special Use permit herein FOUR described is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Cook County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish FIVE: this Ordinance in pamphlet form .
