O-87-540501J/9 ORDINANCE NO. 0 -87 -54 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE-FOR CADWELL'S CORNER-SHOPPING CENTER Published in pamphlet form this 19th day of nCtnher , 1987 by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -87 -54 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL -USE -FOR- CADWELL -'S-CORNER SHOPPING-CENTER WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of American National Bank and Trust Company, as Trustee under Trust No. 48023, Cadwell's Corner Partnership and Salvatore C. Buccola (hereinafter collectively referred to as "Applicant ") to authorize an amendment to the existing Special Use - Commercial Planned Unit Development to approve an expansion of the existing Cadwell's Corner Shopping Center, legally described on Exhibit A, attached hereto and made a part hereof, all in accordance with Articles 5.2 -3, 8, 12.1 -2, 12.5, and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended; and WHEREAS, pursuant to Ordinance 81 -28, the Village of Deerfield previously approved a Special Use - Commercial Planned Unit Development approving the Cadwell's Corner Shopping Center for said real estate. WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission considering and reviewing the ev submitted Site Plan, prepared by attached as Exhibit B hereto and findings of fact and recommended be denied. of the Village of Deerfield after idence adduced by Applicant, the Salvatore C. Buccola & Associates, made a part hereof, made written that said amendment to Special Use WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the granting of the amendment to Special Use of said real estate in accordance with said Exhibit B will serve the best interests of the Village of Deerfield and have therefore not concurred in the Plan Commission's recommendation to deny said amendment to Special Use. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees after ONE: considering and reviewing evidence adduced, the submitted Site Plan prepared by Salvatore E. Buccola and Associates, attached hereto as Exhibit B ORDINANCE NO. 0 -87 -54 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL--USE- FOR -CADWELL'S CORNER-SHOPPING-CENTER does hereby authorize and approve said amendment to Special Use of the real estate legally described on Exhibit A and affirmatively finds the amendment to Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 5.2 -3, 8, 12.1 -2, 12.5 and 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION That the approval and authorization of said amendment TWO: to Special Use is'hereby given subject to the requirement that all use shall be in accordance with all exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance. SECTION That any violation of the conditions hereinabove set THREE: forth shall authorize the revocation of the amendment to Special Use permit hereby authorized. SECTION That all approval and authorization of said amendment FOUR: to Special Use hereby given is subject to the require- ment that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That except to the extent specifically amended hereby, FIVE: all provisions of Ordinance 0 -81 -28 shall remain in full force and effect and all undertakings of the Applicant or its successors, shall remain in full force and effect as if fully restated herein. SECTION That the Village Clerk is hereby directed to publish SIX: Ordinance in pamphlet form. ORDINANCE NO. 0 -87- AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL-USE FOR-CADWELL'S CORNER SHOPPING-CENTER SECTION That this Ordinance shall be in full force and effect SEVEN: from and after its passage, approval and publication, as provided by law.
