O-87-560501J/15 I I ORDINANCE NO. 0 -87 -56 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR LAKE COOK PLAZA SHOPPING CENTER Published in pamphlet 3rd day of November by the President and of Deerfield. form this If 1987, Board of Trustees ORDINANCE NO. 0 -87 -56 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE FOR LAKE COOK PLAZA SHOPPING CENTER WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Lake Cook Plaza Shopping Center and Ada's Famous Deli (hereinafter collectively the "Applicant ") to authorize an amendment to the existing Special Use - Planned Unit Development of Lake Cook Plaza Final Development Plan, all in accordance with Articles 2.0 -3, 2, 5.2 -3, l,d, 12.5 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as amended, for the physical expansion of an existing restaurant in said development to provide cold storage facilities; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering and reviewing the evidence adduced and the Site Plan submitted by Applicant, made written findings of fact and recom- mended that said amendment to the Special Use of said real estate be approved and authorized subject to certain conditions and restric- tions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the amend- ment to the Special Use of the real estate legally described in Exhibit A attached hereto and made a part hereof to approve the physical expansion of the Ada's Famous Deli Restaurant to provide cold storage facilities in accordance with Applicants' Site Plan, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said amendment TWO: to Special Use is hereby given subject to the require- ments that all use shall be in accordance with all exhibits, testimony, representations submitted and made by the Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance. SECTION That the approval and authorization of said amendment THREE: to Special Use hereby given requires a variation from the parking requirements of the Zoning ordinance requiring additional parking spaces due to the proposed expansion and permitting the elimination of existing parking spaces, which variations are hereby authorized and approved, all in accordance with Applicants' Site Plan. SECTION That the Village Clerk is hereby directed to publish SIX: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect SEVEN: from and after its passage, approval and publication, as provided by law.
