O-87-06i . t I ORDINANCE NO. 0 -87 -06 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT Published in pamphlet form this 16thday of March It 1987 by the President and Board of Trustees of Deerfield 0028J/1 I I ORDINANCE NO. 0 -87 -06 AN ORDINANCE AUTHORIZING AN AMENDMENT TO SPECIAL USE IN P -1 PUBLIC LANDS DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Deerfield Park District (herein referred to as "Applicant ") to authorize an amendment to the existing Special Use in the P -1 Public Lands District and a modification of Article 7.5 -5 of the Zoning Code of the Village of Deerfield, as amended, all in accordance with Article 7.6 -2 and Article 13 of the said Zoning Code so as to allow the erection and use of certain lights on the Subject Property (hereinafter defined) and to permit the said lights to exceed the maximum building height and structure height requirements set forth in Article 7.5 -5 of the said Zoning Code; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield after considering the evidenced adduced, made written findings of fact and recommended that said Amendment to Special Use of real estate legally described in Exhibit A attached hereto and made a part hereof (the "Subject Property ") and the modification of said Article 7.5 -5 be approved and authorized subject to certain conditions and restrictions hereinafter set forth; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of the said modification and Amendment to Special Use. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do ONE: affirmatively find that the Amendment to Special Use and modification of said Article 7.5 -5, as hereby authorized and approved, fully complies with the requirements and standards set forth in said Article 7.6 -2 and Article 13, and the Amendment to Special Use for the Subject Property and variation of said Article 7.5 -5 to allow certain lights on the Subject Property to exceed the 35 foot maximum height requirement, as and for the purpose of a public park area, be and the same, is hereby authorized and approved subject to the conditions hereinafter set forth. ORDINANCE NO. 0 -87- 06 SECTION That the approval and authorization of said Amendment TWO: to Special Use is hereby given subject to the requirements that all use shall be in accordance with all exhibits, testimony, representations and document with respect to said modification, submitted and made by the Applicant to the Plan Commission and the President and Board of Trustees, and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Code of the Village of Deerfield. SECTION That the approval and authorization of said Amendment THREE: to Special Use hereby granted is further subject to the condition that all lights located on the Subject Property, except for all security lights, shall be placed on an automatic timer with a shut -off time of 11:00 p.m. The security lights located on the Subject Property shall remain illuminated for one hour after the lights subject to the automatic timer are turned off. SECTION That any violation of any of the conditions THREE: hereinabove set forth shall authorize the revocation of the Amendment to Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois, at Applicant's expense. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
