O-87-19ORDINANCE NO. 0 -87 -19 AN ORDINANCE AMENDING ARTICLES 8 AND 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 4TH day of MAY , 1987, by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0 -87 -19 AN ORDINANCE AMENDING ARTICLES 8 AND 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Board of Trustees of the Village of Deerfield to consider certain text amendments to the Zoning Ordinance; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact in favor of certain of the proposed text amendments to the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendations of the Plan Commission as to the proposed text amendments will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE .IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article 8.2 -4 of the Zoning Ordinance of the ONE: Village of Deerfield, as amended, be and the same is further amended by adding to said Section the following: "6. Floor Area - Outdoor Dining Area. The sum of the total areas devoted to the outdoor dining operation, including, but not limited to, those areas used for the preparation and service of food and /or drink for dining and waiting shall be included in the determination of the gross floor area of a restaurant." SECTION That Article 8.2 -5,2,i of the Zoning Ordinance of the TWO: Village of Deerfield, as amended, be and the same is further amended by adding to said Section the following: "(3) Outdoor Dining Areas Accessory to a Restaurant. Parking shall be provided for accessory outdoor dining areas. The gross floor area of such outdoor dining areas shall be included in the determination of the gross floor area of the restaurant to which it is accessory. 4 The Board of Trustees may, at their discretion, permit the parking required for the accessory outdoor dining area to be either developed at the time the outdoor dining area is constructed or to be held as a landscaped area for possible future parking. The Village may require such covenants and guarantees as may be deemed necessary to insure the availability of the area for possible future development as parking for the outdoor dining area." SECTION That Article 14.2 of the Zoning Ordinance of the THREE: Village of Deerfield, as amended, be and the same is further amended by deleting therefrom the first phrase of the definition "restaurant" and substituting in lieu thereof the following: "RESTAURANT: An establishment (excluding herefrom bakeries, ice cream stores, and similar businesses) whose principal business is the sale of food and /or drink which is prepared and served for immediate consumption either within the restaurant building itself or off premises and development of which takes the following elements into account:" SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict FIVE: herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law.
