AN ORDINANCE AUTHORIZING A SPECIAL USE
PLANNED UNIT DEVELOPMENT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of Deercrest
Limited Partnership, an Illinois limited partnership (Developers)
and LaSalle National Bank, not individually, but as Trustee under
Trust Agreement dated June 1, 1962, and known as Trust No. 29527,
and also under Trust Agreement dated January 24, 1968, known as
Trust No. 36459, (Owners) (herein Owners and Developer are
collectively referred to as "Applicant ") to authorize the
development and use of certain real estate described on Exhibit A
hereto (the "Subject Property ") as a Special Use Planned Unit
Development, under and pursuant to the provisions of Articles 4.5 -3,
12.1 and 12.2 of the Zoning Ordinance of the Village of Deerfield
for 263 dwelling units and accessory uses as hereinafter more
particularly described on the Subject Property and to authorize the
approval of certain variations from Article 12.2 of the Zoning
Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, following consideration of the recommendations of the
Plan Commission and the Preliminary Development Plan by the
President and Board of Trustees, the President and Board of Trustees
have considered and reviewed the submitted Preliminary Signage Plan
and Details, Sheet No. 11, dated May 12, 1986 and revised August 11,
1986, prepared by James Follensbee & Associates, Ltd., the Final
Site Plan - Geometrics and Site Lighting - East, prepared by James
Follensbee & Associates, Ltd., dated February 6, 1987, and the Final
Site Plan - Geometrics and Site Lighting - West, the Final
Landscaping Plan - East, and the Final Landscaping Plan - West, each
prepared by James Follensbee & Associates, Ltd. and each dated
January 26, 1987 (collectively the "Final Development Plan ") and the
Final Plat of Deercrest, prepared by Howard Surveying Company, Inc.,
dated February 16, 1987 (the "Final Resubdivision Plat ") and;
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by the authorization and granting of said Special Use
Planned Unit Development and certain specific variations in
accordance with the Final Development Plan and Final Resubdivision
Plat for the Subject Property marked Exhibit B and attached hereto
and made a part hereof.
NOW, THEREFORE, BE
TRUSTEES OF THE VILLAGE
ILLINOIS, AS FOLLOWS:

IT ORDAINED BY THE PRESIDENT AND BOARD OF
OF.DEERFIELD, LAKE AND COOK COUNTIES,
SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find that the Special Use as hereby
authorized, fully complies with the requirements and
standards set forth in Articles 4.5 -3, 12.1 and 12.2 of the Village
Zoning Ordinance, and the Special Use of the real estate, as and for
purposes of a Planned Unit Development asset forth on Exhibit B
subject to certain conditions and the granting of certain variations
as more particularly set forth below, be and the same are hereby
authorized and approved.
SECTION That the approval and authorization of said Special Use
TWO: hereby granted is subject to the following conditions:
(A) That all use, construction and development shall be in
accordance with the submitted Preliminary Signage Plan
and Details, Sheet No. 11, dated May 12, 1986 and
revised August 11, 1986, prepared by James Follensbee
& Associates, Ltd., and the Final Site Plan -
Geometrics and Site Lighting - East, prepared by James
Follensbee & Associates, Ltd., dated February 6, 1987,
and the Final Site Plan - Geometrics and Site Lighting
- West, the Final Landscaping Plan - East, and the
Final Landscaping Plan - West, each prepared by James
Follensbee & Associates, Ltd. and each dated January
26, 1987 (collectively the "Fina-1 Development Plan "),
and the Final Plat of Deercrest, prepared by Howard
Surveying Company, Inc., dated February 16, 1987 (the
"Final Resubdivision Plat "), a copy of which is
included and marked as part of Exhibit B and attached
hereto and made a part hereof, all other documentary
and exhibit filings made pursuant to Planned Unit
Development Procedures as set forth in Article 12.9 -6
of the Village Zoning Ordinance, the terms of this
Ordinance, and all representations by the Applicant to
the Plan Commission and President and Board of
Trustees.
(B) That the number of dwelling-units on the Subject
Property shall not exceed 263 units.
(C) That the accessory uses on the Subject Property shall
include a beauty parlor, a barbershop, an ice cream parlor,
nursing care facilities, commissary and common dining
facilities and recreational facilities.

(D) That the median sign at the intersection of the Access
Road and Pfingsten Road as shown on the Preliminary
Signage Plan and Details, Sheet No. 11, dated May 12,
1986 and revised August 11, 1986, shall not be
permitted.
(E) That the offsite temporary sign proposed for the
intersection of Pfingsten and Lake -Cook Road or Deer
Lake Road (the "temporary sign ") shall be permitted
subject to the temporary sign being placed on private
property. The temporary sign shall be permitted for
the period beginning six months after ground breaking
and ending one year thereafter.
(F) That the Applicant shall maintain such landscaping
upon Lot 7 in Flodstrom's Subdivision (which is
Village owned property), at least to the standard
established and as shown upon and in accordance with
the Final Landscaping Plan - East, dated January 26,
1987, prepared by James Follensbee & Associates, Ltd.
SECTION That the President and Board of Trustees do hereby
THREE: grant and authorize the following variations:
(A) the parking space requirement of Article 8.2- 5(1)(b)
of the Village Zoning Ordinance shall be reduced to
1.14 per dwelling unit in lieu of the required 1.50
parking spaces for each dwelling unit provided that
.36 parking spaces per dwelling unit is landbanked.
(B) the construction of the required parking stalls with a
2 -1/2 foot grassed bumper overhang shall be permitted
in lieu of the required paving;
(C) a waiver of the required installation of wheel stops;
and
(D) a waiver of the landscape screening requirements shall
be permitted subject to parking spaces and stalls
being within the setback requirements and in
accordance with the Final Development Plan.
SECTION That the Special Use hereby authorized shall be binding
FOUR: upon and inure to the benefit of Applicant's
successors, grantees, transferees and assigns and any
violation of the conditions hereinabove set forth by the Applicant
or its.successors, grantees, transferees or assigns shall authorize
the revocation of the Special Use hereby authorized.

SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form and to record said
Ordinance and that portion of Exhibit B known as the
"Final Development Plan and the Final Resubdivision Plat" in the
office of the Recorder of Deeds of Lake County, Illinois at
Applicant's expense. '
SECTION That this Ordinance shall be in full force and effect

WHEREAS, the Plan Commission of the Village of Deerfield has
