ORDINANCE NO. 0 -86 -24 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE FOR A PRIVATE SCHOOL AT WOODLAND PARK SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the BOARD OF EDUCATION OF SCHOOL DISTRICT 109 and DEERFIELD PARK DISTRICT (collectively the "Applicant ") to authorize the use or occupancy of Woodland Park School, Deerfield, Illinois, for a private school to be operated by Riverside Foundation under and pursuant to the provisions,of Articles 7.2 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to a duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended that said amendment to the special use of said real estate be.approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the special use of the real estate legally described in Exhibit A, attached hereto and made a part hereof, for a private school to be operated by Riverside Foundation with an enrollment limit of 150 students' be and the same is hereby authorized and approved. SECTION That the approval and authorization of said special use TWO: hereby given is subject to the requirements that all use shall be in accordance with all representations submitted and made by Applicant to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance, specifically including the requirements that (a) the enrollment of the private school be limited to a maximum of 150 students; (b) the ratio of staff to student remains as represented to the Plan Commission and Board of Trustees; (c) playground equipment and that portion of the premises depicted on Exhibit B attached hereto and made a part hereof be restricted to public use; (d) sub - leases by Riverside Foundation are prohibited unless approved by the Applicant, the Corporate Authorities and the Deerfield- Bannockburn Fire Protec- tion District; and (e) the foregoing amendment to special use shall lapse following three years from the date of passage hereof unless extended by appropriate action of the Corporate Authorities. ORDINANCE NO. 0 -86 -24 SECTION That the approval and authorization of said special use THREE: hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication, as provided by law.
