ORDINANCE NO. 0 -86 -47 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE WHITEHALL NURSING HOME PROPERTY COMMONLY KNOWN AS 300 WAUKEGAN ROAD, DEERFIELD, ILLINOIS WHEREAS, the WHITEHALL NORTH CONVALESCENT HOME PARTNERSHIP, has petitioned for a variation from the strict provisions of Article 5.2- 6,3,b,(1) of the Zoning Ordinance of the Village of Deerfield passed April 17, 1978, as amended, in connection with the proposed expansion of the use of the property legally described below which would permit the construction of a building addition with a resulting corner side yard along Kates Road of 35 feet in lieu of the required 50 feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the ONE: Zoning Board of Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That the Board of Trustees finds that there are TWO: practical difficulties and particular hardships in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lots 1 and 2 in Golf -View Subdivision, a Subdivision of Part of the S.W. 1/4 of Section 33, Township 43 North, Range 12 East of the Third Principal Meridian, in Lake County, Illinois, all in the Village of Deerfield. Recorded April 1, 1977. Document No. 1827850. Plat Book 59, Page 8. SECTION That a variation from the strict provisions of Article THREE: 5.2- 6,3,b,(1) of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described, is hereby granted, so as to permit a 35 foot corner side yard in lieu of the required 50 feet. ORDINANCE NO. 0 -86 -47 SECTION That the variation hereby granted is subject to FOUR: compliance by the Petitioners with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law.
