AN ORDINANCE FOR THE CONDEMNATION OF LAND FOR
THE ESTABLISHMENT AND MAINTENANCE OF A PUBLIC STREET
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That it is necessary and in the best interest of the
ONE: Village that the Village acquire title to and possession
of the real property described on Exhibit A hereto,
which said real property is necessary, required and needed for the
establishment and maintenance of a public street.
SECTION That Robert Franz, Village Manager, and James K. Stucko,
TWO: Village Attorney, be and they are hereby authorized,
empowered and directed for and on behalf of the Village
of Deerfield to negotiate with the owner or owners of the real estate
hereinabove described for the purchase thereof by the Village.
SECTION That in the event that the said Village Manager and
THREE: Village Attorney are unable to agree with the owner or
owners of said real estate upon the compensation to be
paid therefor, then title and possession of said real estate, as
described aforesaid, shall be acquired by the Village, and James K.
Stucko, as attorney for the Village, is hereby authorized, empowered
and directed to institute proceedings in any court of competent
jurisdiction to acquire title to and possession of said real estate
for the Village in accordance with the eminent domain laws of the
State of Illinois.
SECTION That this Ordinance shall be in full force and effect
FOUR: from and after its passage and approval, as provided by
law.
