O-86-16J � ORDINANCE NO. 0 -86 -16 AN ORDINANCE PROVIDING FOR A LOCAL IMPROVEMENT OF A PORTION OF COUNTRY LANE CONSTRUCTING THEREON CURB AND GUTTER, SIDEWALKS, PAVEMENT, STORM AND SANITARY SEWERS AND WATERMAINS IN THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS SPECIAL ASSESSMENT NO. 116 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS: Section 1: A local improvement shall be constructed in.the Village of Deerfield consisting of the construction of a new portland cement concrete curb and gutter; new bituminous pavement, 28 feet in width (back -to -back of curb) consisting of 4 inches of sub -base granular material, 6 inches of bituminous base course, 1 1/2 inches of bituminous concrete binder course and 1 1/2 inches of bituminous concrete surface course; new portland cement concrete sidewalks, 5 feet wide and 5 inches thick; new sanitary sewers, storm sewers and watermains of the necessary size and the respective house services for each of the above; new storm sewer and sanitary sewer manholes and new watermain valve vaults and valves; and landscaping and such other incidental work as may be necessary to complete the construction of Country Lane from approximately-150 feet west of the centerline of Kenmore Avenue to approximately 540 feet west of the centerline of Kenmore Avenue, a net length of 390 lineal feet being located in the Village of Deerfield, Lake County, Illinois. It shall be necessary to acquire title to and possession of the following described real property, which said real property is necessary, required and needed for the purpose of constructing the sidewalks, curb and gutter and pavement to the widths provided for said improvemment, and shall be obtained by condemnation in accordance with the provisions pertaining thereto in Article 9, Division 2 of Chapter 24 of the Illinois Revised Statutes, to -wit: The South 30 feet of Lots 134, 133, 132 and the South 30 feet of the East 35 feet of Lot 131, and the North 30 feet of Lots 137, 138, 139 and the North 30 feet of the East 35 feet of Lot 140, all in the Subdivision of J.S. Hovland's First Addition to Deerfield, a Subdivision of the Southwest 1/4 (except the Northwest 1/4 of the Northwest 1/4 thereof) of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian in Lake County, Illinois. Section 2: Said improvement shall include the installation of an inlet, a catch basin, manholes, storm sewer pavement drains, a valve vault and gate valve, fire hydrant and necessary service connections, the same shall be constructed and details concerning the same shall be in accordance with plans and special provisions pertaining thereto, prepared by the engineering firm of Richard A. Miller and Associates, Inc., in accordance with the standard specifications for water and sewer main construction in Illinois, current edition, and the standard specifications for road and bridge construction, adopted October 1, 1983 by the Illinois Department of Transportation, and local ordinances and specifications pertaining thereto; which plans, special provisions and specifications are on file in the office of the Village Engineer, Village Hall, 850 Waukegan Road, Deerfield, Illinois, and are incorporated herein by reference and made a part of this Ordinance. Section 3: Village Datum for the purpose of this improvement is fixed and established as the official datum of the United States Geological Survey. All materials of every kind and character to be used in the construction of this improvement shall be of first class quality, and suitable for the purpose for which they are to be used. The quantities and types of materials to be used are as set forth in the Estimate of Cost attached hereto and incorporated herein by reference. All construction work shall be done in a workmanlike manner, under the supervision of and subject to the approval of the said engineering firm. Section 4: The Recommendation of the Board of Local Improvements, the Estimate of Cost thereof, the Plans and Special Provisions, all hereto attached and incorporated herein by reference, be,and the same are hereby approved. - 2 - .Section 5: The said improvement shall be made and the cost thereof which is estimated to be $154,148.70, including $8,725.40 being the amount included in the Estimate as the cost of making, levying, and collecting the assessment herein, shall be paid for by special assessment in accordance with Article 9, Division 2 of Chapter 24 of the Illinois Revised Statutes as amended, and from other funds on hand of the Village of Deerfield, Illinois. Section 6: The aggregate amount herein ordered to be assessed pursuant to this special assessment and each individual assessment therein shall be divided into ten (10) installments which shall bear interest at the rate of nine percent (9 %) per annum until paid, all in the manner and in accordance with theprovisions of the aforesaid Article 9, Division 2 of Chapter 24 of the Illinois Revised Statutes, as amended. Section 7: For the purpose of anticipating the collection of the second and succeeding installments of said assessment for said improvement, bonds may be issued payable out of said installments, bearing interest at the rate of nine percent (9 %) per annum, payable annually and signed by the President of the Village and attested by the Village Clerk, under the corporate.seal of the Village. Bonds shall be issued in accordance with and shall in all respects conform to the provisions of Article 9, Division 2 of Chapter 24 of the Illinois Revised Statutes, as amended. Section 8: James R. Stucko and David C. Newman, attorneys representing this Village with respect to the aforesaid improvement, are directed to file a Petition in the Circuit Court of Lake County, Illinois, in the name of the Village of Deerfield, praying that steps may be taken to ascertain the just compensation to be made for private property taken or damaged to be acquired for the said improvement, and to ascertain what property will be benefited by said improvement, and the amount of such benefit and also that steps be taken to levy a special assessment for said improvement in accordance with the provisions of this Ordinance and in the manner prescribed by law. - 3 - �r Section 9: This Ordinance shall be in full force and effect from and after its passage and approval in accordance with law.
