O-86-20ORDINANCE NO. 0 -86 -20 AN ORDINANCE GRANTING MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 111 PFINGSTEN ROAD, DEERFIELD, ILLINOIS WHEREAS, the Lincoln Property Company has petitioned for a modifi- cation from the strict provisions of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the display of a single -faced non - illuminated real estate sign at a maximum height of 14 feet above the curb in lieu of the permitted 10 feet and having a surface area of 100 square feet in lieu of the permitted 20 square feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the ONE: Zoning Board of Appeals recommending approval of the petition are adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find that TWO: unnecessary or undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described on Exhibit A attached hereto and made a part hereof. SECTION That a modification from the strict provisions of THREE: Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted to as to permit the display of the following sign: A non - illuminated single -faced sign up to 100 square feet in size, and with its maximum height not to exceed 14 feet above grade and to be permitted for a period not to exceed 12 months at the location approved by the Village'of Deerfield Safety Counci1,.­ —., . ORDINANCE NO. 0 -86 -20 SECTION That the modification hereby granted is subject to FOUR: compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage and approval, as provided by law.
