ORDINANCE NO. 0 -85 -37 AN ORDINANCE AMENDING CHAPTER 5 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEE RFIELD OF 1975 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 5 -6 entitled "Killing dangerous animals" ONE: of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said section in its entirety and substituting in lieu thereof the following: "Section 5 -6. Killing dangerous animals. The members of the Police Department or the Animal Warden as provided in Section 5.36 hereof, are hereby authorized to kill any dangerous animals of any kind when it is necessary for the protec- tion of any person or property." SECTION That Section 5.7 entitled "Diseased animals; TWO: regulations" of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said section in its entirety and substituting in lieu thereof the following: "Section 5 -7 Diseased animals; regulations. (a) No domestic animal afflicted with a contagious disease shall be allowed to run at large, or to be exposed in any public place whereby the health of man or beast may be affected; nor shall such diseased animal be shipped or removed from the premises of the owner thereof; except under supervision of the Lake County Health Officer. (b) It is the duty of the Lake County Health Officer to secure such disposition of any diseased animal and such treatment of affected premises as to prevent communication and spread of contagion or infection, except in cases where the state veterinarian is empowered to act." SECTION That subsections (a) and (c) of Section 5 -12 entitled THREE: "Register and license required" of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same are further amended by deleting said IORDINANCE NO. 0 -85- 1 subsections in their entirety and substituting in lieu thereof the following: (a) Any person who keeps, harbors or otherwise maintains a dog more than four (4) months of age in the Village shall register and procure a license for the same not later than January 1 .in each year. (c) Any dog less than four (4) months of age shall also be registered and licensed as provided herein not later than fifteen (15) days after the same becomes four (4) months of age." SECTION That subsection (b) of Section 5 -14 entitled "License FOUR: tag" of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by deleting said subsection in its entirety and substituting in lieu thereof the following: "(b) Upon payment of the required license fee, any dog less than four ' (4) months of age may be registered and licensed for purposes of identifi- cation without a certificate of inoculation against rabies; provided that a certificate of inoculation against rabies shall be filed with the Village Manager not later than fifteen (15) days after said dog becomes four (4) months of age." SECTION That Section 5 -15 entitled "Animal license fee" of FIVE: Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said section in its entirety and substituting in lieu thereof the following: "Section 5 -15. Animal license fee. The license fee shall be five dollars ($5.00) for each dog for each year or fraction thereof; provided, however, when a dog is purchased or otherwise acquired or becomes four (4) months of age after June 30 in a license year, the license fee shall be reduced fifty percent (50 %) for that license year. SECTION That subsection (a) of Section 5 -16 entitled SIX: "Inoculation against rabies of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said subsection in its entirety and substituting in lieu thereof the following: IORDINANCE NO. 0 -85- r "(a) No person shall permit any dog or cat over the age of four (4) months to be on any street or other public place or in any enclosed space other than the premises of the owner of the animal unless such animal has.been inoculated against rabies by a licensed veterinarian within the preceding year." SECTION That Section 5 -17 entitled "Collar and tag" of SEVEN: Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said section in its entirety and substituting in'lieu thereof the following: "Section 5 -17. Collar and tag. Every owner shall provide each dog, more than four (4) months of age kept, harbored or otherwise maintained by him in the Village with a sturdy collar to which the aforesaid license tag shall be securely fastened and it shall be the owner's duty to make certain that the collar and tag are worn at all times by the dog when off the owner's premises." SECTION That subsections (a) , (c) , (d) and (e) of Section 5 -22 EIGHT: entitled "Dog bites; reports; impoundment; compliance requirements" of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said subsections in their entirety and substituting in lieu thereof the following: "_(a) It shall be the duty of the owner of any dog to prevent such dog from biting or attacking any person in the Village, and if a person is bitten by a dog he shall immediately report the incident to the Lake County Health Department at telephone number 689 -6424 or any replacement telephone number therefor. '(c) If an_- owner.has notice that his dog has bitten any person, it shall be unlawful for such owner to kill such dog, or sell or give such dog away, or to permit or allow such dog to be taken beyond the limits of the Village except to a licensed veterinary hospital, but it shall be the duty of such owner to immediately report the incident to the Lake County Health Department at telephone number 689 -6424 or any replacement telephone number therefor. ORDINANCE NO. 0 -85- (d) In the event that such animal is confined to a veterinary hospital all costs of maintaining such animal shall be the obligation and responsi- bility of the owner and shall be paid by said owner. (e) For the purpose of this section, the word 'immediately' means by telephone, in person, or by other than use of the mail." SECTION That subsection (c) of Section 5 -26 entitled "Rabies; NINE: regulations: of Chapter 5 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said subsection in its entirety and substituting in lieu thereof the following: "(c) It shall be the duty of every person who discovers that any dog is suffering with rabies or that any dog or other animal has been bitten by a dog or other animal suffering with rabies to report such fact immediately to the Lake County Health Department at telephone number 689 -6424 or any replacement telephone number therefor." SECTION That the Village Clerk is hereby directed to publish TEN: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect ELEVEN: from and after its passage, approval and publication as provided by law.
