O-85-50ORDINANCE NO. 0 -85 -50 AN ORDINANCE AMENDING THE ZONING MAP - SOUTHEAST CORNER OF LAKE -COOK AND PFINGSTEN ROADS WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing upon the Petition of LINCOLN- DEERFIELD, LTD., an Illinois limited partnership (hereinafter referred to as "Applicant "), for the classification of certain real estate located within the Village, and legally described on Exhibit A attached hereto and made part hereof ( "Parcel 1 ") and certain real estate located within the Village and legally described on Exhibit B attached hereto and made part hereof ( "Parcel 2 ") in the I -1 Office, Research, Restricted Industrial District and to authorize the granting of a Special Use - Industrial Planned Unit Development in accordance with Exhibits presented to the Plan Commission; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended a map amendment to the Zoning Ordinance of the Village of Deerfield and the approval of the resubdivision to achieve the objectives sought by the Applicant; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the classification of said real estate in the manner aforesaid. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION ONE: That the Zoning Map of the Village of Deerfield included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit "A ", attached hereto and made a part hereof, to the I -1 Office, Research, Restricted Industrial District. SECTION TWO: That upon the Village's receipt of written notice by Applicant, delivered within ninety (90) days of the adoption and passage of this Ordinance, stating that Applicant or ,�T)oe . A .J a4i-e its affiliates has acquired control over Parcel 2 and that agreements between the Applicant and the owners of property adjacent and contiguous to the eastern boundary of Parcel 1 have been completed to the Applicant's satisfaction, the zoning map of the Village of Deerfield included and made a part of the Village's Zoning Ordinance passed April 17, 1978, as amended, shall thereupon, and without further action by the President and Board of Trustees, be further amended by zoning and classifying the property described in Exhibit B attached hereto and made a part hereof to the I -1 Office, Research, Restricted Industrial District. In the event that the Applicant fails to deliver the notice described herein within the specified time, Parcel 2 shall remain subject to the zoning district regulations applicable upon the date of the adoption and passage of this Ordinance. SECTION THREE: That the Village Clerk is hereby directed to publish this Ordinance in pamphlet form. SECTION FOUR: That and effect from publication, as and after provided this Ordinance shall be in full force its passage, approval and by law.
