ORDINANCE NO. 0 -85 -07 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of Harris Trust and Savings Bank, as Trustee under the provisions of a Trust Agreement dated August 22, 1980, known as Trust No. 40599, Harris Trust and Savings Bank, as Trustee under the provisions of a Trust Agreement dated October 12, 1983, known as Trust No. 42460 and Carl G. Schmidt, as Trustee of the Carl G. Schmidt Trust under the provisions of a Trust Agreement dated January 4, 1972 (collectively the "Owners "), and Lake - Cook /Tollway Associates, an Illinois limited partnership (the "Developer ") (the Owners and Developer herein jointly referred to as "Applicant ") to authorize an amendment to Ordinance No. 84 -57 authorizing a Special Use - Industrial Planned Unit Development to provide for the development and use of certain real estate described on Exhibit A hereto and for a Special Use - Planned Unit Development, under and pursuant to the provisions of Articles 6.1 -3, 5, 12.1, 12.1 -2, 12.8 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, the President and Board of Trustees have considered and reviewed the Amended Final Development Plan for the Subject Property, consisting of an amendment to the Temporary Signage Plan for the ArborLake Centre to provide for temporary leasing signs together with an accompanying Exhibit thereto prepared by the Applicant and submitted by Applicant in addition to all other documentary filings required by the Zoning Ordinance of the Village of Deerfield reflecting the amendments to the final Temporary Signage Plan as contemplated by Ordinance No. 84 -57; and WHEREAS, the President and Deerfield have determined that be served by the authorization Special Use - Industrial Planned the amended Temporary Signage hereto and made a part hereof. Board of Trustees of the Village of the best interests of the Village will and granting of said Amendment to Unit Development in accordance with Plan marked Exhibit B and attached NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: r" r SECTION That the President and Board of Trustees do hereby ONE: affirmatively find the Amended Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Article 13.11 -4 of the Village Zoning Ordinance, and the Amended Special Use of the real estate, as and for purposes of an Industrial Planned Unit Development including the Temporary Signage Plan as set forth on Exhibit B. be and the same is hereby authorized and approved. SECTION That all use, construction and development shall be in TWO: accordance with the amended Final Development and the amended Temporary Signage Plan, a copy of which is marked Exhibit B and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance and all representations by the Applicant to the Plan Commission and President and Board of Trustees. Said approved Temporary Signs shall be permitted for a period of two years at the locations depicted on Exhibit B and shall be as follows: A. A double -faced sign fronting on Lake -Cook Road not to exceed 10' x 20' per sign face with the bottom of the sign a maximum of 4' above grade if obstructions exist in the area which require the additional height, otherwise the bottom of said sign shall be no more than 2' above grade. The maximum angle of the sign as measured at the point of the V may be no more than 90 °. The sign may be illuminated with overhead fluorescent light. B. A single -faced sign fronting on the Tri -State Tollway not to exceed 10' x 20' in size. The bottom of said sign may be a maximum of 8' above grade. The sign may be illuminated with overhead fluorescent light. C. A double -faced sign fronting on the Edens Highway Spur not to exceed 10' x 20' per sign face. The bottom of the sign may be a maximum of 8' above grade. The maximum angle of the sign as measured at the point of the "V" may be no more than 900. The sign may be illuminated with overhead fluorescent light. SECTION That any violation of the condition hereinabove set THREE: forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Amended Special Use granted hereby. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form and to record said Ordinance and Exhibit B in the office of the Recorder of Deeds of Cook County, Illinois at Applicant's expense. SECTION That except to the extent specifically amended hereby, FIVE: all provisions of Ordinance No. 84 -57 shall remain in full force and effect and all undertakings of the Applicant or its successors, shall remain in full force and effect as if fully restated herein. SECTION That this Ordinance shall be in full force and effect SIX: from and after its passage, approval and publication, as provided by law.
