ORDINANCE NO. 0 -85 -21 AN ORDINANCE AMENDING THE OFFICIAL COMPREHENSIVE PLAN FOR THE VILLAGE OF DEERFIELD, ILLINOIS WHEREAS, the Corporate Authorities of the Village of Deerfield and its residents, for more than 55 years, have been concerned with land use in the Village and have planned for the orderly growth and development of the Village, as evidenced by the following; and WHEREAS, the Corporate Authorities have previously reviewed and updated the Comprehensive Plans which have been adopted from time to time by the Village; and WHEREAS, on February 19, 1979, by passage of Ordinance 79 -6 the Corporate Authorities adopted the Official Comprehensive Plan presently in effect; and WHEREAS, Section Four of said Ordinance 79 -6 provides that said Official Comprehensive Plan may be amended from time to time; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have requested the Village Plan Commission in 1984 to consider certain amendments to the Official Comprehensive Plan and to prepare, pursuant to the authority of Section 11 -12 -1, et seq., of the Illinois Municipal Code (Chapter 24, Ill.Rev.Stat. 1981) and recommend the same to the Corporate Authorities; and' WHEREAS, the Village Plan Commission held hearings on January 10, 1985 and February 14, 1985 with respect to proposed amendments to the Official Comprehensive Plan and the various parts thereof, after published notice thereof, and thereafter, the Plan Commission formulated its recommendations thereon; and WHEREAS, The President and Board of Trustees have determined that it is in the best interests of the Village to adopt certain amendments-to the Official Comprehensive Plan and, in particular, to adopt the amendments as recommended by the Village Plan Commission, it being understood that such Official Comprehensive Plan, as amended, may hereafter be supplemented and augmented by additional plans and maps, and that said Plan may hereafter be implemented by various ordinances which may be considered and adopted. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:. SECTION Short Title. This Ordinance shall be known as may be ONE: cited as "An Ordinance Amending the Official Compre- hensive Plan." S I SECTION TWO: Plan in the public, and Pure se. SECTION Availability of Copies of the Ordinance. The Village FIVE: Clerk shall keep in the Village Hall for inspection by interested persons, copies of this Ordinance. The Clerk shall also make available copies of the Ordinance for purchase at cost, either through duplication in advance of contemplated demand or upon order as required. The foregoing copies of 'the Ordinance shall be in addition to the original copy which the statutes require the Clerk to keep as part of the official record of enacted ordinances. SECTION Severability. Any provisions of this Ordinance held SIX: invalid shall not affect the validity of the remaining provisions. SECTION Repeal. All ordinances or parts of.ordinances in SEVEN: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION Procedure for Adoption - Effective Date. This Amend - EIGHT: ment to the Comprehensive Plan Ordinance shall become effective uon its passage and approval, the filing of a notice of adoption of such Amendment to the Official Comprehensive Plan with the County Recorders of Lake and Cook Counties, which notices the Village Clerk is hereby directed to file, and upon the expiration of ten (10) days following the filing of such notice. Right -of -way dedications should be requested where appropriate for possible future interior streets. Only those interior right -of -ways should be improved which are extensions of and are contiguous to other improved right -of -ways. Wherever possible, cul -de -sacs should be utilized rather than having ,through streets bisecting blocks. In light of the difficulties posed in'the past by the diverse ownership, lack of streets, and absence of street planning. for the two -block area bounded by Wilmot, Lake -Cook, Gordon and Birchwood, the Village should, in addition to its general overall policy for the Hovland area, actively pursue whatever affirmative st f s are required to acquire whatever right -of -way is necessary for the extension of Country Lane through the two =block area and to improve that right -of -way and the unimproved portion of the Kenmore right -of -way which Kies south of Gordon Terrace. q, Controlled Access to Lake Cook Road and to Wilmot Road Access to Lake -Cook Road and to Wilmot Road from individual properties will be prohibited except in those situations where there is no alternative access to a particular property. Country Lane should be extended westward from Birchwood, but it should not intersect with Wilmot Road. The Kenmore right -of -way south of Gordon should be terminated in a cul -de -sac and �a should not intersect with Lake -Cook Road. Any presently dedicated right -of -way which is not required for street purposes should be vacated. i 5. Special Development Considerations for Area Bounded by Lake -Cook Raod, Wilmot Road, Gordon Terrace and Birchwood The Village strongly encourages the development of the properties in this area in a manner consistent with the overall development pattern in the Hovland area. Cul -de -sacs should be utilized to provide access to properties from Country Lane which properties might otherwise access directly onto Lake -Cook Road or Wilmot. Road. Where appropriate,. variations of frontyard setbacks should be considered so as to permit the siting of homes on the lots adjacent to Lake -Cook Road or to Wilmot Road further away from those roads. This increase in rear -yard setbacks and the provision of a• landscaping easement along those rear lot lines will help to buffer those residences from those roads (see Appendix for possible street and lot configurations) . ., 2 i 5 2 POSSIBLE DEVELOPMENT AREA 9 Hovland b The Hovland area consists of the sixteen blocks which lie between Lake -Cook' Road and Hackberry and between Willow and Wilmot Road. A number of the blocks in this residential area are fully developed under the original provisions controlling development in the area or redeveloped., under the special provisions previously adopted by the Village which also provided improved streets and utilities to the overall area. L•K[ - COOK The Village recognizes that the portion of the Hovland area bounded by Lake Cook Road, Wilmot Road, Gordon Terrace and Birchwood has not been able to develop at the same rate. as the rest of Hovland because of the diversity of the ownership of the properties, the lack of utilities and the lack of improved streets to access the interior portions of the two blocks (see.shaded area on map above) . It is the Village's strong desire to see these two blocks as well as other properties in the Hovland area developed or redeveloped in a manner consistent with the residential neighborhood in which they are located. Specifically, the following objectives will be sought regarding the entire Hovland area in general and the two block area bounded by Lake -Cook Road, Wilmot Road, Gordon Terrace, and Birchwood in particular: 1. Limited Use Commercial, office or industrial use of any portion of the Hovland area is not recommended: The residential character of the Hovland area should 'be maintained. The residential use of all properties in the Hovland area is strongly recommended. 2. Low Impact Development The development of the undeveloped or 'underdeveloped properties in the Homeland area should be consistent with the overall low density development of the Hovland area.
