RESOLUTION NO. 0 -80 -11
A RESOLUTION OBJECTING TO A TEXT AMENDMENT
TO THE LAKE COUNTY ZONING ORDINANCE
WHEREAS, the Planning and Zoning Committee of the Lake County Board has
favorably recommended to the Lake County Board that it consider a text amend -
ment'to the Lake County Zoning Ordinance which would permit a cluster housing
developments: pursuant to the PUD provisions of the Lake County Zoning Ordinance
( "Cluster Zoning Amendment ") without permitting filing of written protests as
presently provided in Article Four, Section IV, 6 of the Lake County Zoning
Ordinance; and
WHEREAS, the Lake County Board is presently considering adoption of said
Cluster Zoning Amendment; and
WHEREAS, the proposed text amendment would affect all areas of unincorpor-
ated Lake County lying adjacent to and within one - and - one -half miles of the
corporate limits of the Village of Deerfield, a zoned municipality; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield
are of the opinion that the adoption of the Cluster Zoning Amendment would be
contrary to the best interest of the Village of Deerfield and of the community,
generally in that the text amendment could result in the development of cluster
housing without enabling nearby communities such as the Village of Deerfield
to consider the desirability of such developments on a case -by -case basis as
presently provided by the PUD provisions of the Lake County Zoning Ordinance,
thus depriving said communities of their legal right to file formal protests,
should they so desire, and thereby permitting such developments without regard
for the character and compatibility of surrounding or nearby properties,
particularly the substantial single - family residentially zoned and used areas
of the Village of Deerfield and would further tend to attract the traffic,
noise, congestion and other accompanying undesirable features of such intensive
land uses,
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the Village of Deerfield, pursuant to Chapter 34, Section
ONE: 3158, Illinois Revised Statutes 1979, hereby protests and objects
to the adoption of the Cluster Zoning Amendment herein described.
SECTION That the Village Clerk is hereby directed to forward a certified
TWO: copy of this Resolution to the Lake County Zoning Board of
Appeals, the Board of Supervisors of Lake County and the County
Clerk of Lake County.
