AN ORDINANCE AUTHORIZING A SPECIAL USE -
INDUSTRIAL PLANNED UNIT DEVELOPMENT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of AMERICAN
NATIONAL BANK AND TRUST COMPANY as Trustee under a Trust Agreement
dated August 31, 1983 and known as Trust Number 59087 (herein
referred to as "Applicant ") to authorize the development and use of
certain . real estate described on Exhibit A hereto for a Special
Use - Planned Unit Development, under and pursuant to the provisions
of Articles 6.1 -3,5, 12.1, 12.1 -2, 12.8 and 13.11 of the Zoning
Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, following consideration of the recommendations of the
Plan Commission, and- the Preliminary Development Plan by the
President and Board of Trustees, the President and Board of Trustees
have considered and reviewed the Final Development Plan for Phase 1
consisting of a Final Site Plan for Phase 1 prepared by
Barton - Aschmann Associates, Inc. dated October 25, 1984 and a
Landscape Plan, Phase 1, (collectively hereinafter referred to as
the "Final Development Plan "), submitted by Applicant reflecting all
revisions from the original Preliminary Development Plan; and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by -the authorization and granting of said Special
Use - Industrial Planned Unit Development in accordance with the Final
Development Plan,for the Subject Property marked Exhibit B and
attached hereto_and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND.COOK COUN'T'IES,
ILLINOIS, AS FOLLOWS:
SECTION ;That the President and Board of Trustees do hereby
ONE: affirmatively find that the Special Use, as hereby
authorized, fully complies with the requirements and
standards set forth in Articles 12.8 and 13.11 -4 of the Village
Zoning Ordinance, and the Special Use of the real estate, as and for
purposes of an Industrial Planned Unit Development as set forth on
Exhibit B, be and the same is hereby authorized and approved subject
to the conditions hereinafter set forth.
SECTION 'That the approval and authorization of said Special

conditions:
(A) That all use, construction and development shall be in
accordance with the Final Development Plan, dated October 25,
1984 prepared by Barton- Aschmann Associates, Inc., a copy of
which is marked Exhibit B and attached hereto and made a part
hereof, all other documentary and exhibit filings made pursuant
to Planned Unit Development Procedures as set forth in Article
12.9 of the Village Zoning Ordinance, the terms of this
Ordinance, and all representations by the Applicant to the Plan
Commission and President and Board of Trustees, specifically
including but not limited to the following:
1. Applicant consents to approval of Phase 2 as depicted
on Exhibit B in concept only. Specific future
development proposals for Phase 2 shall be considered
pursuant to Village Industrial Planned Unit
Development procedures.
2. Applicant consents to limit ancillary retail business
uses in Phase 1 primarily for the use of tenants to a
book and stationery store and office supply store
comprising not more than 7,500 square feet in-each building
in Phase.-1 and, in addition, a sit -down restaurant
operated primarily for the use of tenants of the
development having operating hours reflecting the
hours of operation of the tenants of the development
and not exceeding 8,000 square feet in area.
3. Applicant consents to a limitation of 3,000 square
feet for a Health Club to be operated in Phase 1 as a
recreational facility whose membership may include
both tenants of the development and the public.
4. Applicant consents to an area limitation of 20,000
square feet in Phase I in the event a portion of the
development is utilized for medical and /or dental
clinics and offices and in that event Applicant
further agrees to provide parking to accommodate such
uses at the greater of either the requirements
contained in Article 8 of the Village Zoning Ordinance
or 5.6 spaces per thousand gross square feet of
leaseable floor space devoted to said uses.
5. Applicant consents to bear all costs whenever incurred
.including design and street reconfiguration, median
reconstruction and signal inter - connection devices in
connection with the signalization of the eastern
access driveway to the Subject Property from Lake -Cook
Road. In furtherance of this obligation, Applicant
will use its best efforts in assisting the Village of
Deerfield and any other governmental bodies having
jurisdiction in implementing the signalization project
at the earliest possible date.
6. Applicant agrees to provide a permanent utility
easement in form satisfactory to the Village to
provide for the relocation of Village utilities in the
event said relocation is required by future
improvements to Lake -Cook Road.
7. Applicant agrees to connect the existing access from
Kates Road to the Subject Property to service regular
and emergency vehicular traffic in addition to all
construction traffic.
8. Applicant consents to the issuance of a one year
temporary sign permit providing for a double -faced
sign not greater than either 10 feet by 20 feet in
size or the sign permitted the Lake Cook Office Centre
Development. Further, said sign shall not exceed 16
feet in height with the bottom of the message board to
be no more than 6 feet above the ground. Illumination
of the sign shall be limited to external illumination
with white lights.
SECTION That any violation of any of the conditions herein -
THREE: above set forth by the Applicant or its successors,
grantees, transferees or assigns shall authorize the
revocation of the Special Use hereby authorized.
SECTION As part of this Ordinance granting the Special Use
FOUR: and approving the Final Development Plan, the
following modifications of the regulations established
in the I -1 Office, Research, Restricted Industrial District are
hereby authorized, all in accordance with the Final Development Plan
and the representations of the'Applicant:
1. A variation of the eastern and western perimeter
setback provisions to permit parking in the eastern
and western side yards.
2. A variation of the provisions of Chapter 19 of the
Municipal Code to permit the construction of driveways
as depicted on the Final Development Plan.
3. A variation of the landscaped screening of parking
areas requirement along the western perimeter to
permit landscaping as depicted in the Final
Development Plan which is less than the densely
planted evergreens five feet in height or five -foot
berm or combinations of evergreens and berming to the
five feet in height.
4. A variation of the landscaped screening requirement
along the southern portion of the eastern property
line to permit landscaping thereon as depicted in the
Final Development Plan.
5. A variation to exclude certain atrium and public
access areas from required parking square footage
computations.
6. A variation from the strict requirements of the Zoning
Ordinance provisions so as to initially provide
parking at a ratio of 3.3 spaces per thousand square
feet of gross leasable floor space. As a condition of
this variation the Applicant agrees to landbank an
area equal to the difference between the 4.0 spaces
per thousand square feet required pursuant to the
Zoning Ordinance and the number resulting from the 3.3
spaces per thousand square feet of gross leaseable
floor space.
7. A variation from the strict provisions of the Zoning
Ordinance to permit parking stalls 17.5 feet by 8.5
feet in size and two -way parking aisles 23 feet in
width.
8. A variation to permit a 40 foot side yard rather than
the required 50 foot side yard as to the easternmost
building included in Phase I.
SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form and to record said
Ordinance and that portion of Exhibit B known as the
"Final Site Plan" in the Office of the Recorder of Deeds of Lake
County, Illinois at Applicant's expense.
SECTION That this Ordinance shall be in full force and effect
