ORDINANCE NO. 0 -84-41 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE — COMMERCIAL PLANNED UNIT DEVELOPMENT - MARRIOTT HOTEL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of SVEN FLODSTROM and the MARRIOTT CORP. (herein jointly referred to as "Applicant ") for the reclassification of certain property legally described on Exhibit A hereto to the C -2 Outlying Commercial District and to authorize the development and use of said real estate for a Special Use - Planned Unit Development, under and pursuant to the provisions of Articles 5.2 -3, 12.1, 12.5 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the Final Development Plan consisting of a Final Land Use Plan for the Marriott Hotel prepard by Camiros, Ltd. dated August 1, 1984, and a Landscaping Plan prepared by Barton - Aschman Associates, Inc. dated June 30, 1984 (hereinafter collect- ively referred to as the "Final Development Plan "), submitted by Applicant reflecting all revisions from the original Preliminary Development Plan; and WHEREAS, the President and Board of Trustees of the Village'of Deerfield have determined that the best interests of the Village will be served by the reclassification of the Subject Property in the C -2 Outlying Commercial District and the authorization and granting of said Special Use - Commercial Planned Unit Development in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the Village of Deerfield ONE: included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit A, attached hereto and made a part hereof, to the C -2 Outlying Commercial District. SECTION That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.5 and 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate as and for purposes of a Commercial Planned Unit Development as set forth on Exhibit B, be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use THREE: hereby granted is subject to the conditions that: (a) All use, construction and development of the Marriott Hotel shall be in accordance with the Final Development Plan, a copy of which is included and marked as part of Exhibit B and attached hereto and made a part hereof, all other documentary and Exhibit filings made pursuant to Planned Unit Development procedures as forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees; and (b) Upon the improvement of Pfingsten Road north of Lake -Cook Road, the Applicant shall at its expense close off and remove all improvements necessitated by the Lake -Cook Road access drive to the Marriott Hotel, including those within the Lake -Cook Road right -of -way. SECTION As part of this Ordinance granting the Special Use and FOUR: approving the Final Development Plan, the following modifications of the regulations established in the C -2 Outlying Commercial District are hereby authorized, all in accordance with the Final Development Plan and the representations of the Applicant: (a) The paved parking stall depth may include the curb overhang in order to meet the overall required parking depth dimension. (b) Parking lot curbing may be used in lieu of wheel stops. (c) Applicant may provide less than the required 5 -foot high evergreen screening along the western property line in accordance with the Landscaping Plan. (d) Applicant may eliminate the 5 -foot high evergreen landscaped screening required along the north and east property lines in accordance with the Landscaping Plan. (e) Applicant shall provide the joint landscaping development along the eastern property line and on adjacent property in accordance with the Landscaping Plan. (f) Parking may encroach into the 5 -foot required setback along the eastern property line. (g) Access to the subject property may be provided from a public right -of -way utilizing or adjoining owner's property. (h) Applicant may provide an off -site directional sign on property not part of the subject property. (i) Applicant may locate its business sign at the location depicted on the Landscaping Plan. SECTION That any violation of the conditions hereinabove set FIVE: forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish SIX: this Ordinance in pamphlet form and to record said Ordinance and Exhibit B known a the "Final Development Plan" in the Office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense.
