AN ORDINANCE AMENDING ARTICLES 6, 8 and 14
OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of Harris Trust
and Savings Bank, as Trustee under the provisions of a Trust Agree-
ment dated August 22, 1980, known as Trust No. 40599, Harris Trust
and Savings Bank, as Trustee under the provisions of a Trust Agree-
ment dated October 12, 1983, known as Trust No. 42460 and Carl G.
Schmidt, as Trustee of the Carl G. Schmidt Trust under the provisions
of a Trust Agreement dated January 4, 1972, (collectively the
Owners ") and Lake - Cook /Tollway Associates, an Illinois Limited
Partnership (the "Developer ") (the Owners and the Developer herein
jointly referred to as "Applicant ") to consider certain text
amendments to the Zoning Ordinance relative to the inclusion of
hotels as a Special Use in the I -1 Office, Research, Restricted
Industrial District and other amendments
related thereto; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of fact in
favor of the proposed text amendments to the Zoning Ordinance of the
Village of Deerfield; and
WHEREFORE, the President and Board of Trustees of the Village of
Deerfield have determined that the recommendations of the Plan
Commission will serve the best interests of the Village of Deerfield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Article 6.1 -3 of the Zoning Ordinance of the
ONE: Village of Deerfield, as amended, be and the same is
further amended by adding a new subsection 8 as
follows:
118. Hotels, provided such use is developed as part of
a Planned Industrial Development of a minimum of
30 acres; and further provided that such Planned
Industrial Development shall include both office
and hotel uses and shall be located adjacent to
Interstate Highway 94 (also known as the Edens
Spur) and Highway 294 (also known as the Tri-
State Tollway). No hotel may be located within
600 feet of the center line of Lake -Cook Road."
SECTION That Article 6.1 -5 of the Zoning Ordinance of the
TWO: Village of Deerfield, as amended, be and the same is
further amended by adding thereto a new subsection 7
as follows:
"7. When part of a I -1 PUD, the following uses (in
addition to those uses provided primarily for
registered hotel guests which are customarily and
historically accessory to a hotel) may be per-
mitted as accessory to a hotel use when located
within the hotel or when located on the hotel
grounds, [excluding the service and /or storage of
alcoholic beverages] and /or operated primarily
for the use of the registered guests of the hotel:
a. Restaurant
b. Banquet and ballroom facilities
(including food and /or liquor service
when required)
C. Liquor service including:
(1) lounge areas and
(2) free standing complimentary service
areas when limited to regular and
specified hours of daily service
and located as provided on the
Final Development Plan for the I -1
PUD
d. Live entertainment
e. Recreational and social facilities
(swimming pool, exercise areas limited
to hotel guests and their visitors)
f. Meeting /conference rooms
g. Convenience item shops
h. Laundry and housekeeping facilities
i. Vending machines"
SECTION That Article 8.2 -5,2 of the Zoning Ordinance of the
THREE: Village of Deerfield, as amended, be and the same is
further amended by adding a new subsection "m" as
follows:
"m. Hotels -- 1.4 parking spaces per guest room."
SECTION That Article 14 of the Zoning Ordinance of the
FOUR: Village of Deerfield, as amended, be and the same is
further amended by adding the definition of Hotel as
follows:
"Hotel. A building containing not less than
75
and not more than 300 individual sleeping rooms or
suites for the purposes of providing overnight lodging
facilities to the general public for compensation
and
in which the principal means of ingress and egress
to
and from all rooms is made through an inside lobby
supervised by a person in charge at all hours and
which
provides a common entrance, halls and stairways.
Accessory uses, except as modified by any other
provisions of this Ordinance, shall be limited to
those uses customarily and historically accessory
to a
hotel and provided primarily for the comfort and
accommodation of guests of the hotel."
SECTION That the Village Clerk is hereby directed to publish
FIVE: this Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances in conflict
SIX: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That this Ordinance shall be in full force and effect
SEVEN: from and after its passage, approval and publication,
as provided by law.
