ORDINANCE NO. 0 -84 -55 AN ORDINANCE AMENDING ARTICLE 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Harris Trust and Savings Bank as Trustee of Trust No. 40599 under a Trust Agreement dated August 22, 1980 and as Trustee of Trust No. 42460 under a trust dated October 12, 1983 and Carl G. Schmidt as Trustee of the Carl G. Schmidt Trust under the provisions of a Trust Agree- ment dated January 4, 1972 to consider certain text amendments to those portions of the Zoning Ordinance pertaining to signage requirements and limitations for Hotels included in Planned Unit Developments located in the I -1 Office, Research and Restricted Industrial District; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact in favor of the proposed text amendments to the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendations of the Plan Commission as to the proposed text amendments will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article 9 of the Zoning Ordinance of the Village ONE: of Deerfield, as amended, be and the same is further amended by deleting Article 9.2 -3,2 and substituting in lieu thereof the following: "9.2 -3,2 Industrial Park Signs One additional ground sign on each street frontage, other than those signs permitted and regulated in Article 2 -3,1 above and those signs as permitted and regulated in Article 9.2 -3,5 pertaining to a hotel as part of a Planned Unit Development in I -1 Office, Research and Restricted Industrial District." SECTION That Article 9 of the Zoning Ordinance of the Village TWO: of Deerfield, as amended, be and the same is further amended by adding thereto Article 9.2 -3,5, as follows: "9.2 -3,5 Signage for Hotels located in a Planned Unit Development in the I -1, Office, Research and Restricted Industrial District a. Number. (1) Wall Signs. (a) Hotel. Not more than one (1) wall sign shall be permitted which sign shall face a limited /controlled access highway and shall contain only the name and logo of the hotel. (b) Hotel Entry Sign. Not more than one (1) wall sign shall be permitted designating /identifying the main entrance to the hotel. (c) Signs for Accessory Uses Within the Hotel. Not more than one (1) wall sign shall be permitted designating/ identifying the uses within the hotel accessed by an- entry. (2) Ground Signs. (a) Off -Site Signs. Not more than one (1) off -site ground sign shall be permitted. The off -site sign shall be permitted only if an agreement allowing such an off -site sign is submitted to the Village signed by the owner of the property where the sign is to be located, and only if said sign is more than 10 feet from the lot line. (b) Limited /Controlled Access Highway Signs. Not more than one (1) ground sign shall be permitted which, by its location and orientation within the Planned Unit Development, is visible principally from a limited /controlled access highway. (c) On -Site Ground Signs. Not more than one (1) on -site ground sign shall be permitted for a hotel within a I -1 Planned Unit Development except as otherwise provided for in Article 9.2- 3,5,a,2,b. b. Area. (1) Wall Signs. (a) Hotel. the maximum surface area for a wall sign facing a limited /controlled access highway shall not exceed one hundred thirty five (135) square feet. (b) Hotel Entry Sign. The maximum surface area for a hotel entry sign shall not exceed twenty four (24) square feet. (c) Signs for Accessory Use Within the Hotel. The maximum surface area for a sign for accessory uses within the hotel shall not exceed fifty eight (58) square feet. (2) Ground Signs. (a) Off -Site Signs. The maximum surface area shall not exceed one hundred twenty (120) square feet for each exposed face nor exceed an aggregate surface area of two hundred forty (240) square feet. The pedestal upon which the sign stands shall not be included within the surface area of the sign. The distance between sign faces shall not be included within the surface area of the sign. (b) Limited /Controlled Access Highway Signs. The maximum surface area shall not exceed ninety six (96) square feet for each exposed face nor exceed an aggre- gate surface area of one hundred ninety two (192) square feet. The distance between sign faces shall not be included within the surface area of the sign. (c) On -Site Ground Signs. The maximum surface area shall not exceed twenty four (24) square feet for each exposed face nor exceed an aggregate surface area of forty eight (48) square feet. The pedestal upon which the sign stands shall not be included within the surface area of the sign: C. Location. (1) Wall Signs. (a) Hotel Sign. A hotel sign may be located on the outermost wall of a hotel which wall faces a limited/ controlled access highway. (b) Hotel Entry Signs. A hotel entry wall sign may be located at the main entrance to the hotel either on the wall above the entrance or on a canopy over the entrance. (c) Signs for Accessory Uses Within the Hotel. A sign designating /identifying the accessory uses accessed by an entry other than the main hotel entrance shall be located on the wall alongside of or above that entry or on a canopy over that entry. (2) Ground Signs. (a) Off -Site Signs. No off -site sign may be approved until an agreement with the property owner is submitted to the Village. No off -site sign shall be located more than six hundred fifty (650) feet from the property on which the hotel is located, and in no event shall the sign be less than 10 feet from the lot line. Said sign shall be in conformance with all other Village codes and ordinances. (b) Limited /Controlled Access Highway Signs. A limited /controlled access highway sign may be located within a required building setback but in no event may the sign be more than forty (40) feet from the limited /controlled access highway right -of -way from which it is intended that it be seen. In no event shall said sign be oriented so that one of its faces is parallel to a residen- tially zoned area. (c) On -Site Ground Signs. On -site ground signs may be located in a required building setback but shall be more than ten (10) feet from any property line. d. Height. (1) Wall Signs. No wall sign, as permitted in Article 9.2- 3,5,a(1) shall project higher than the parapet line of the roof of the hotel. (2) Ground Signs. (a) Off -Site and On -Site Ground Signs. No off -site or on -site ground sign shall project higher than ten (10) feet above the elevation of the nearest curb. (b) Limited /Controlled Access Highway Signs. No limited /controlled access highway sign shall project more than thirty -two (32) feet above the elevation of the nearest curb. SECTION That the Village Clerk is hereby directed to publish THREE: this Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict FOUR: herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication as provided by law. AYES: Marty, Seidman, Swanson, York (4).
