ORDINANCE NO. 0-84-56 AN ORDINANCE AMENDING SECTIONS 3- 1(a)(4), 3 -8, 3 -8A, 3 -9, 3- 11(a)(3) AND 3 -18A OF ARTICLE ONE OF CHAPTER 3 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: .SECTION That Section 3- 1(a)(4) entitled "Definitions" of ONE: Article 1 of Chapter 3 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said section in its entirety and substituting in lieu thereof the following: 11(4) "Hotel ": Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where meals are actually and regularly served and consumed, where sleeping accommodations are offered for pay to travelers and guests, whether transient, permanent or residential, in which twenty five (25) or more rooms are used for the sleeping accommodations of such guests, having one (1) or more public dining rooms where meals are served to such guests, where alcoholic liquor may be served and /or' stored in separate liquor service or lounge areas which are adjacent to food service areas, where live entertainment may be provided in connection with said service or meals and /or alcoholic liquor. The sleeping accommodations, dining rooms and liquor service areas shall be in the same building or buildings, and such building or buildings, structure or structures shall be provided with adequate and sanitary dining room and kitchen equipment and capacity. No more than 33% of the total square footage of said building, buildings or structures which is devoted to the regular preparation and service of meals, in addition to said lounge areas, shall be employed .for the service and /or storage of alcoholic liquor. The following shall not be considered in the calculation of said percentage: 1. Liquor service and /or storage in connection with room service. 2. Complimentary liquor service within the confines of any atrium space where such service is limited to registered guests and their visitors and to regular and specified daily hours." SECTION That Section 3- 1(a)(9) entitled "Definitions" of TWO: Article 1 of Chapter 3 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by deleting said section in in its entirety and substituting in lieu thereof the following: "(9) Retail sale ": The sale for use or consumption and not for resale." SECTION That Section 3 -8 entitled "Classes of Licenses" of THREE: Article 1 of Chapter 3 of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is further amended by adding the following Class G: "CLASS G, which shall authorize the sale on the premises specified of alcoholic liquor only for consumption on the premises and only in accordance with the terms. of Section 3 -1, (a) (4) hereof. Such licenses may be issued only to hotels as such uses are defined in Section 3 -1, (a) (4) of this chapter. SECTION That Section 3 -8A of Article 1 of Chapter 3 of the FOUR: Municipal Code of the Village of Deerfield of 1975, as amended, is hereby amended by striking said Section in its entirety and substituting in lieu thereof the following: "Seca 3 -8A. Fees. The annual license fees for the various classes of liquor licenses shall be as follows: Class A Class B Class BB Class C Class D Class D -1 Class E. Class F, per event Wine tasting permits (per special permit) not to exceed 4 per year, available only to Class A and Class B license holders upon proper application 50.00 wine tasting. 3,000.00 " $2,000.00 750.00 1,000.00 1,000.00 1,500.00 500.00 2,500.00 25.00 pe r Class G SECTION That Section 3 -9 of Article 1 of Chapter 3 of the FIVE: Municipal Code of the Village of Deerfield of 1975, as amended, is hereby further amended by striking said section in its entirety and substituting in lieu thereof the following: "There shall be issued in the Village no more than: Class A Five (5) Class B None (0) Class BB One (1) Class C Three (3) Class D One (1) Class D -1 One (1) Class E Six (6) Class F None (0) Class G None (0) licenses to be in effect at one time." SECTION That Section 3- 11(a)(3) entitled "Closing Hours" of SIX: Article 1 of Chapter 3 of the Municipal Code of the Village of Deerfield, as amended, by adding the following after the words provided, that restaurant ." in line 3 thereof: "club and hotel" SECTION That Section 3 -18A of Article 1 of Chapter 3 of the SEVEN: Municipal Code of the Village of Deerfield of 1975, as amended, is hereby further amended by adding the following at the conclusion thereof: "Nothing herein shall prohibit the dispensation of alcoholic beverages free of charge on the premises of a hotel, as defined in this chapter, during limited and specified hours daily, for the purpose of providing for the convenience of the registered guests therein and their visitors, but not with the intention of promoting the sale of alcoholic beverages." SECTION That the Village Clerk is hereby directed to publish EIGHT: this Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict NINE: herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect TEN: from and after its passage, approval and publication, as provided by law.
