AN ORDINANCE AMENDING SECTION 22 -19 OF CHAPTER 22 OF
THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Section 22 -19 entitled "Driving while under the
ONE: influence of alcohol, other drug, or combination
thereof" of Chapter 22 of the Municipal Code of the
Village of Deerfield of 1975, as amended, be and the same is further
amended by adding new subsection 22 -19.3 "Penalty" as follows:
"Sec. 22 -19.3. Penalty.
Every person who is convicted of a violation of
Section 22 -19 shall be guilty of a Class A
misdemeanor as provided in Chapter 38 of the
Illinois Revised Statutes, and shall be subject
to a fine of up to $1,000.00, and /or imprisonment
for any term less than one year. In addition to
such penalty herein or any other administrative
action provided by this Code or by statute, for
any second or subsequent conviction of violating
this Section within 5 years of a previous viola-
tion thereof, such person shall be mandatorily
sentenced to a minimum of 48 consecutive hours of
imprisonment or assigned to a minimum of 10 days
of community service as may be determined by the
Court. Such imprisonment or assignment shall not
be subject to suspension nor shall the person be
eligible for probation in order to reduce the
sentence or assignment."
SECTION The Village Clerk is hereby directed to publish this
TWO: Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances in conflict
THREE: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That this Ordinance shall be in full force and effect
FOUR: from and after its passage, approval and publication
as provided by law.
