I ORDINANCE NO. 0 -84 -34 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE - COMMERCIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of DR. FRANK SEIFRIED (herein referred to as "Applicant ") for the reclassifi- cation of certain property legally described on Exhibit A hereto in the C -3, Limited Commercial Office District and to authorize the development and use of said real estate for a Special Use - Planned Unit Development, under and pursuant to the provisions of Articles 5.3- 3,6,b, 12.1, 12.6 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects; held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the Final Development Plan consisting of a site plan for the Deerfield Medical and Dental Professional Office Building dated July 17'9 1984, and a landscaping plan prepared by Missner & Lirtzman dated July 10, 1984 (hereinafter collectively referred to as the "Final Development Plan "), submitted by Applicant reflecting all revisions from the original Preliminary Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the reclassification of the Subject Property in the C -3, Limited Commercial Office District and the authorization and granting of said Special Use - Village Center /Commercial Planned Unit Development in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the Village of Deerfield D_ff_E: included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit A, attached hereto and made a part hereof, to the C -3, Limited Commercial Office District. SECTION- That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.6 and 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Village Center /Commercial Planned Unit Development as set forth on Exhibit B, be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use THREE: hereby granted is subject to the conditions that: (a) All use, construction and development shall be in accordance with the Final Development Plan, a copy of which is included and marked as part of Exhibit B and attached hereto and made a part hereof, all other documentary and Exhibit filings made pursuant to Planned Unit Development procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees; and (b) In the event that in the determination of the Corporate Authorities future parking needs require additional parking, the Applicant will provide up to seven (7) additional parking spaces in the area designated on Exhibit B. SECTION. As part of this Ordinance granting the Special Use and FOUR: approving the Final Development Plan, the following modifications of the regulations established in the C -3, Limited Commercial Office District are hereby authorized, all in accordance with the Final Development Plan and the representations of the Applicant: 1. Parking shall be permitted in the perimeter set back. 2. The loading berth requirement is waived, except that if the medical and dental occupancy of the building becomes less than 80% of the total uses in the building, a loading berth must be provided. 3. Wheel stops may be eliminated and the parking lot curbing will be provided. 4. Signage shall be permitted as depicted on Exhibit B .. 5. The landscaped screening requirements be modified so as to permit (a) A fence along the northern, eastern and western boundary lines with the area in front of the fence being landscaped with deciduous bushes (no minimum height requirement) (b) The southern property line shall be landscaped as depicted on Exhibit B. 6. The amount of required open space shall be varied in accordance with Exhibit B. SECTION That any violation of the conditions hereinabove set FIVE: forth by the Applicant or his successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish SIX: this Ordinance in pamphlet form and to record said Ordinance and Exhibit B known as the "Final Develop- ment Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect SEVEN: from and after its passage, approval and publication, as provided by law.
