ORDINANCE NO. 0 -84 -07 AN ORDINANCE AUTHORIZING A SPECIAL USE - INDUSTRIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of S. GUY FISHMAN, EDWIN A. MCGUIRE, JOSEF J. CEISEL, JAMES E. O'HALLORAN, JR., LaSALLE NATIONAL BANK, not individually, but as Trustee under a Trust Agreement dated April ..27, 1977 and commonly known as Trust No. 52096, LaSALLE NATIONAL BANK, not individually, but as Trustee under a Trust Agreement dated April 19, 1978 and commonly known as Trust No. 54210, NORTHBROOK TRUST & SAVINGS BANK, not individually, but as Trustee under a Trust Agreement dated February 27, 1979 and commonly known as Trust No. LT -2048, and NORTHBROOK TRUST AND SAVINGS BANK, not individually, but as Trustee under a Trust Agreement dated February 27, 1979 and commonly known as Trust No. LT- 2049,and TRAVENOL LABORATORIES, INC. (herein collectively referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A hereto for a Special Use - Industrial Planned Unit Development, under and pursuant to the provisions of Articles 6.1 -3, 5, 12.1, 12.1 -2, 12.8 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, and the Preliminary Development Plan by the President and Board of Trustees, the President and Board of Trustees have considered and reviewed the Final Development Plan consisting of an Amended Final Land Use Plan and Final Landscaping Plan (collectively hereinafter referred to as the "Final Development Plan "), submitted by Applicant reflecting all revisions from the original Preliminary Development Plan; and WHEREAS, The President and Board of Deerfield have determined that the best will be served by the authorization and Use - Industrial Planned Unit Development Development Plan for the Subject Proper attached hereto and made a part hereof. Trustees of the Village of interests of the Village granting of said Special in accordance with the Final ty marked Exhibit B and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.8 and 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of an Industrial Planned Unit Development as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use TWO: hereby granted is subject to the following conditions: That all use, construction and development shall be in accordance with the Amended Final Land Use Plan, dated October 27, 1983 prepared by Travenol Laboratories, Inc., and the Final Landscaping Plan prepared by David N. Carlson & Associates, dated August 8, 1983, a copy of each of which is marked Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, and all reprsentations by the Applicant to the Plan Commission and President and Board of Trustees, specifically including but not limited to the following: 1. Applicant consents to complete the reguired. landscaping of the Real Estate in accordance with the development phasing schedule submitted to the Village in accordance with Articles 12.9 of the Village Zoning Ordinance. 2. Applicant or its successors, grantees, transferees or assigns shall comply with and succeed to the obliga- tions of "Owners" and /or "Travenol" as set forth in a certain Annexation Agreement governing the Subject Property dated March 9, 1984, specifically including, but not limited to, the execution and performance of easement agreements with the owners of the adjoining properties to the east and west and the completion of the dedication of Huehl Road. SECTION That any violation of the conditions hereinabove set THREE: forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION As part of this Ordinance granting the Special Use and FOUR: approving the Final Development Plan, the following modifications of the regulations established in the I -1 Office, Research, Restricted Industry District are hereby authorized, all in accordance with the Final Development Plan and the representations of the Applicant: A. A variation in the east side yard requirement is granted in that, after the 25' Dedication of the easternmost 25 feet of the Subject Property, the building set -back will be 41 feet from the east boundary, B. A variation from the parking requirements in that, after exclusion of open atrium areas and reception areas from gross square foot calculations, the parking provided will be 51 cars less than that required, of which 23 will be available for future use but will be planted at this time. These figures do not include a credit for the 56 spaces lost due to the Dedication of the easternmost 25 feet of the property, C. A variation from the parking set -back requirements on the south, east and west boundaries of the property in accordance with Exhibit B, and C. A variation from Article 8.2 -3,5 and 8.2 -3,9 regarding elimination of wheel stops, curbing and roping in parking areas. SECTION That the Village Clerk is hereby directed to.publish FIVE: this Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Amended Final Land Use Plan" in the office of the Recorder of Deeds of Cook County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect SIX: after its passage, approval and publication, as provided by law.
