AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE - COMMERCIAL AND INDUSTRIAL PLANNED UNIT DEVELOPMENTS WHEREAS, the Plan Commission of. the Village of Deerfield has heretofore held a public hearing on the application of SCM/BUCCOLA/ DiPIETRO (herein collectively referred to as "Applicant ") to reclassify certain real estate described on Exhibit A and identified as Parcel 1 from the I -2 Limited Industrial'District to the C -2 Outlying Commercial District, and to authorize the development and use of said real estate as a Special Use - Commercial Planned Unit Development and to authorize the development of certain additional real estate described on Exhibit A and identified as Parcel 2 for a Special Use - Planned Unit Development as an Industrial Planned Unit Development all under and pursuant to the provisions of Articles 5.2 -3,8, 6.2 -3, 8, 12.1, 12.1 -2, 12.5, 12.8 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, and the Preliminary Development Plan by the Presi- dent and Board of Trustees, the President and Board of Trustees have considered and reviewed the Final Planned Unit Development Plan dated January 4, 1984 prepared by Bonesz, Maas, Buccola, Architects, for Parcels 1 and 2, submitted by Applicant in addition to all other documentary filings required by the Zoning Ordinance of the Village of Deerfield reflecting all revisions from the original Preliminary Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the classification of Parcel 1 in the C -2 Outlying Commercial District and the authorization and granting of said Special Use - Commercial and Industrial Planned Unit Development for both Parcels 1 and 2 in accordance with the Final Planned Unit Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE. AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the ONE: included and made a part o Ordinance passed April 17, further amended by zoning and classifying Parcel 1 in Exhibit "A ", attached hereto the C -2 Outlying Commercial District. Village of Deerfield f the Village Zoning 1978, as amended, is hereby the.property described as and made a part hereof, in SECTION That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Article 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Commercial and Industrial Planned Unit Development as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use THREE: hereby granted is subject to the conditions that all use, construction and development shall be in accor- dance with the Final Planned Unit Development Plan, dated January 4, 1984, prepared by Bonesz, Maas, Buccola, Arthitects, a copy of which is marked Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 of the,Village Zoning Ordinance, the terms of this Ordinance, and all representa- tions by the Applicant to the Plan Commission and President and Board of Trustees. SECTION That any violation of any of the conditions hereinabove FOUR: set forth by the Applicant or their successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION As part of this Ordinance FIVE: approving the Final Plann following modification of in the I -2 Office, Research, Restricted Outlying Commercial District are hereby with the Final Planned Unit Development of the Applicant: granting the Special Use and ed Unit Development Plan, the the regulations established Industry District and C -2 authorized, all in accordance Plan and the representations 1. Permit location of a contractor's office and shop, within 500 feet of a residential development. 2. Waiver of the requirement for roping of parking stalls. 3. Elimination of the landscape screening requirements of parking areas for the development with the following exceptions: a. Prior to development of the northernmost proposed building, Applicant shall obtain Plan Commission approval of the specific plans for the building and landscaping. b. Landscape screening consisting of a row of evergreen bushes must be provided at the top of the embankment on the eastern side of the Subject Property to screen the Subject Property from the adjacent property to the east. 4. Waiver of the minimum lot area requirement of two acres per use. 5. Permit parking or buildings in the required perimeter setbacks in accordance with the Final Planned Unit Development Plan. 6. The following signage shall be permitted: a. One off -site sign not to exceed 6 feet by 10 feet located at least five feet from the Lake -Cook Road right -of -way and in compliance with all applicable Village sight line regulations. b. One on -site sign for the development in compliance with the provisions of the zoning Ordinance. C. Tenant signs with each such sign limited to a total of 10 square feet in area (two 1 foot by 5 foot panels), the construction, color and size of the lettering to be controlled by the Applicant but uniform throughout the development. SECTION That the Village Clerk is hereby directed to publish SIX: this Ordinance in pamphlet form and to record said Ordinance and that.portion of Exhibit B known as the "Final Planned Unit Development Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect SEVEN: from and after its passage, approval and publication as provided by law.
