ORDINANCE NO. 0 -84 -17 AN ORDINANCE AMENDING THE ZONING MAP AND AUTHORIZING A SPECIAL USE - COMMERCIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of THEODORE J. GALVANI (herein referred to as "Applicant ") for the reclassification of certain property legally described on Exhibit A hereto in the C -1 Village Center Commercial District and to authorize the development and use of said real estate for a Special Use - Planned Unit Develop - ment, under and pursuant to the provisions of Articles 5.1 -3,10, 12.1, 12.5 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, and the Preliminary Development Plan by the Presi- dent and Board of Trustees, the President and Board of Trustees have considered and reviewed the Final Development Plan dated January 27, 1984 (hereinafter referred to as the "Final Development Plan "), submitted by Applicant reflecting all revisions from the original Preliminary Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the reclassification of the Subject Property in the C -1 Village Center Commercial District and the authorization and granting of said Special Use - Commercial Planned Unit Development in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the Zoning Map of the Village of Deerfield ONE: included and made a part of the Village Zoning Ordinance passed April 17, 1978, as amended, is hereby further amended by zoning and classifying the property described in Exhibit "A ", attached hereto and made a part hereof, to the C -1 Village Center Commercial District. SECTION That the President and Board of Trustees do hereby TWO: affirmatively find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.5 and 13.11 -4 of the _Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Commercial Planned Unit Development as set forth on Exhibit B, be and the same is, hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use THREE: hereby granted is subject to the conditions that: (a) All use, construction and development shall be in accordance with the Final Development Plan, dated January 27, 1984 prepared by D.W. McMasters, Architect, a copy of which is included and marked as part of Exhibit B and attached hereto and made apart hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.9 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees; and (b) In the event the existing screening along the southern portion of the eastern property line is removed or is to be replaced, the Applicant will screen that area in accordance with the applicable Zoning Ordinance provisions. SECTION As part of this Ordinance granting the Special Use and FOUR: approving the Final Development Plan, the following modification of the regulations established in the C -1 Village Center Commercial District are hereby authorized, all in accordance with the Final Development Plan and the representations of the Applicant: 1. Elimination of landscape screening /fencing required along the western property line abutting the railroad right -of -way. 2. Modification of the landscaping screening requirement along the southern portion of the eastern boundary of the C -1 Planned Unit Development in accordance with the Final Development Plan. 3. Permit parking in the required five foot western side yard. SECTION That any violation of the conditions hereinabove set FIVE: forth by the Applicant or his successors, grantees, transf'errees or assigns shall authorize the revocation of the Special Use hereby authorized. .4 r SECTION That the Village Clerk is hereby directed to publish SIX: this Ordinance in pamphlet form and.to record said Ordinance and Exhibit B known as the "Final Develop- ment Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense.
