AN ORDINANCE AUTHORIZING A
SPECIAL USE -BILL KNAPP'S RESTAURANT
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of MR. IRL
MARSHALL and BILL KNAPP'S PROPERTIES, INC. (herein jointly referred
to as "Applicant ") for approval of a Special Use for a Bill Knapp's
Restaurant on a portion of the premises legally described in Exhibit
A attached hereto and made a part hereof under and pursuant to the
provisions of Articles 5.2 -3, 5.2 -6.1. 13.4 -2(2) and 13.11 of the
Zoning Ordinance of the Village of Deerfield: and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law: and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of fact and
recommended that the Special Use as proposed be approved and author-
ized subject to certain conditions and restrictions hereinafter set
forth and that certain variations from the strict requirements of
the Zoning Ordinance be granted in connection therewith: and
WHEREAS, the President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by the approval of the Special Use for a portion of
the premises in accordance with the testimony and documentary
evidence presented by Applicant to the Corporate Authorities.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERF.IELD. LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find that the Special Use as proposed by
Applicant fully complies with the requirements and
standards set forth in Article 13.11 -4 of the Zoning Ordinance of
the Village of Deerfield and the Special Use of a portion of the
real estate, as and for purposes of Bill Knapp's Restaurant as
proposed by Applicant, be and the same is hereby authorized and
approved subject to the conditions hereinafter set forth.
SECTION That the approval and authorization of said Special
TWO: Use hereby granted is subject to the condition that
development by the Applicant conform in all respects
to both the Site Plan and the Landscape Development Plan attached
hereto and made a part hereof as Exhibit B. and that the development
of the remainder of the premises described "in Exhibit A shall be
deemed a Special Use.
SECTION That any violation of the conditions hereinabove set
THREE: forth shall authorize the revocation of the Special
Use hereby authorized.
SECTION As part of this Ordinance granting the Special Use,
FOUR: the following modifications of the regulations estab-
lished in the C -2 Outlying Commercial District are
hereby authorized, all in accordance with the Site Plan and the
representations of Applicant:
1. A variation of the parking and loading dock provisions
to permit elimination of roping and curb stops and a
loading dock of lesser size as depicted on the Site
Plan.
2. A variation of the landscaped screening requirements
(a) to permit deciduous plantings rather than
evergreens along the southern and western property
lines; (b) to permit landscaping along said southern
and western property lines as depicted in the
Landscape Development Plan; and (c) to permit
berming /landscaping along the eastern property line
within the dedicated parkway area.
SECTION That this Ordinance shall be in full force and effect
FIVE: from and after its passage, approval and publication
as provided by law.
SECTION That the Village Clerk is hereby directed to publish
