AN ORDINANCE AUTHORIZING AN AMENDMENT TO AN
EXISTING SPECIAL USE - COMMERCIAL AND INDUSTRIAL
PLANNED UNIT DEVELOPMENT AND APPROVING AN ADDITION THERETO
WHEREAS, the Plan Commission of the Village of Deerfield has
heretofore held a public hearing on the application of SVEN
FLODSTROM (herein referred to as "Applicant ") to authorize an
amendment to Ordinance No-..82-43 authorizing a Special
Use - Commercial and Industrial Planned Unit Development and the
approval of an addition thereto to provide for the development and
use of certain real estate described on Exhibit A hereto and for a
Special Use - Planned Unit Development, under and pursuant to the
provisions of Articles 5.2 -3,8, 12.1, 12.1 -2, 12.5 and 13.11 of the
Zoning Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice
thereof and was, in all respects, held according to law; and
WHEREAS, following consideration of the recommendations of the
Plan Commission, the.President and Board'of Trustees have considered
and reviewed the Amended Final Development Plan of that portion of
the Subject Property identified and designated as 11C -2 PUD East ",
consisting of an Amended Final Land Use Plan and an Amended Final
Landscape Plan for the restaurant portion of the C -2 PUD East,
submitted by applicants in addition to all other documentary filings
required by the Zoning Ordinance of the Village of Deerfield
reflecting all revisions from the original Final Development Plan
which was made a part of Ordinance No. 82 -43; and
WHEREAS, The President and Board of Trustees of the Village of
Deerfield have determined that the best interests of the Village
will be served by the authorization and granting of said Amendment
and Addition to Special Use - Commercial Planned Unit Development in
accordance with the Amended Final Development Plan for the C -2 PUD
East marked Exhibit B and attached hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby
ONE: affirmatively find that the Amended Special Use and
the Addition thereto, as hereby authorized, fully
complies with the requirements and standards set forth in Article
13.11 -4 of the Village Zoning Ordinance, and the Amended Special Use
and Addition thereto of the real estate, as and for purposes of an
Commercial Planned Unit Development as set forth on Exhibit B. be

and the same is hereby authorized and approved subject to the
conditions hereinafter set forth.
SECTION That the approval and authorization of said Amended

1983, prepared by Camiros. Ltd., a copy of which is marked Exhibit B
and attached hereto and made a part hereof,.all other documentary
and exhibit filings made pursuant to Planned Unit Development
Procedures as set forth in Article 12.9 of the Village Zoning
Ordinance, the terms of this Ordinance and all representations by
the Applicant to the Plan Commission and President and Board of
Trustees.
SECTION_ That any violation of the condition hereinabove set

transferees or assigns shall authorize the revocation
of the Special Use hereby authorized.
SECTION As part of this Ordinance granting the Amended Special

are hereby authorized, all in accordance with the Amended Final Land
Use Plan and the representations of the Applicant:
1. Permit parking in the required side and rear yard

2. Modification of the landscape screening
requirement so as to permit deciduous plant
material in lieu of evergreen planting in
accordance with the Amended Final Landscape Plan
for the C -2 PUD East.
SECTION That the Village Clerk is.hereby directed'to publish
FIVE: this Ordinance in pamphlet form and to record said
Ordinance and that portion of Exhibit B known as the
"Amended Final Land Use Plan" in the office of the Recorder of Deeds
of Lake County, Illinois at Applicant's-.expense.
SECTION That except to the extent specifically amended hereby,
