O-83-13t' ORDINANCE NO. 0 -83 -13 AN ORDINANCE AMENDING ARTICLES 5, 13 and 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 2nd day of May , 1983, by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0 -83 -13 AN ORDINANCE AMENDING ARTICLES 5, 13 AND 14 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Village of Deerfield to con- sider certain text amendments to the Zoning Ordinance to classify restaurants as a Special Use rather than a Permitted Use in the C -1 Village Center District and the C -2 Outlying Commercial District and to consider amendments to the definition of "Restaurant" and to certain Special Use Standards con- tained in Article 13; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and 'WHEREAS, the Plan Commission of the Village of Deerfield, after con - sidering the evidence adduced, made written findings of fact in favor of the proposed text amendments to the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendation of the Plan Commission will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article 5.1 -2,1 of the Zoning Ordinance of the Village of ONE: Deerfield, as amended, be and the same is further amended by deleting "gg. Restaurants: (1) Sit -Down, (2) Carry -Out Type" from the enumeration of permitted Retail Business Uses. SECTION That Article 5.1 -3,1.f of the Zoning Ordinance of the Village of TWO: Deerfield, as amended, be and the same is hereby further amended by deleting "Restaurants with facilities for dining outdoors" from the enumeration of Special Uses - Retail Business Uses and substituting in lieu thereof "Restaurants." SECTION That Article 5.1 -2,1 of the Zoning Ordinance of the Village of THREE: Deerfield, as amended, be and the same is hereby further amended by deleting "11. Restaurants: (1) Sit -Down, (2) Carry -Out Type" from the enumeration of permitted Retail Business Uses. SECTION That Article 5.2 -3•,1 of the Zoning Ordinance of the Village of FOUR: Deerfield, as amended, be and the same is hereby further amended by retaining Section d "Restaurant" and by deleting Subsection d(l) thereof in its entirety and renumbering Subsection d(2) to Subsection d(1). SECTION That Article 13.11 -4,2,a of FIVE: of Deerfield, as amended, amended by deleting said thereof the following: the Zoning Ordinance of the-Village be and the same 'is hereby further Subsection and substituting in lieu "a. Compatible with Existing Development The nature and intensity of the activities involved and the size, placement and design of any structures proposed will be so planned that the Special Use will be compatible with the existing development and will not impede the normal and orderly development and improvement of surrounding property." SECTION That Article 14.2 of the Zoning Ordinance of the Village of SIX: Deerfield, as amended, be and the same is hereby further amended by deleting therefrom the definitions of "Restaurant, Carry -Out" and "Restaurant, Sit -Down" as contained therein and substituting in lieu thereof, the following: "Restaurant An establishment whose principal business is the sale of food and /or drink which is prepared and served for immediate consumption either within the restaurant building itself or off premises and development of which takes the following ele- ments into account: 1. A design which promotes harmonious transi- tions in scale and character in areas between different designated land uses. 2. Compatibility of design with the immediate environment of the site. 3. Compatibility with future construction both on and off the site. 4. Amount and arrangement of open space and landscaping appropriate to the design and function of the structures. 5. Adequate provision for safe and convenient access to the property and traffic and pedestrian circulation within the property for pedestrians, cyclists, and vehicles. 6. Preservation and integration of natural fea- tures of the property without and within the project. 0 7. Compatibility of the details of design with the adjacent and neighboring structures and functions." SECTION That the Village Clerk is hereby directed to publish this SEVEN: Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict herewith EIGHT: are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect from and NINE: after its passage, approval and publication, as provided by law.
