AN ORDINANCE AMENDING ARTICLE 9 OF THE
ZONING ORDINANCE OF THE VILLAGE OF DEERIFLED
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore
held a public hearing on the application of the Village of Deerfield to
consider certain text amendments to those portions of the Zoning Ordinance
pertaining to real estate Open House signs and Open House directional signs;
and
WHEREAS, said hearing was held pursuant to duly published notice thereof
and was, in all respects, held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after
considering the evidence adduced, made written findings of fact in favor of
the proposed text amendments to the Zoning Ordinance of the Village of
Deerfield; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield
have determined that the recommendation of the Plan Commission will serve the
best interests of the Village of Deerfield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Article 9 of the Zoning Ordinance of the Village of
ONE: Deerfield, as amended, be and the same is, further amended by
adding thereto Article 9.3 -9 as follows:
"9.3 -9 Open House Signs and Open House Directional Signs
In addition to real estate signs as regulated by
Article 9.3 -2 Real Estate Signs, signs indicating an
"Open House" for the purpose of showing a house shall
be permitted only in accordance with the following
provisions.
1. Number
a. There shall not be more than one (1) Open
House sign per zoning lot, except that on a
corner lot, two (2) such signs, one (1) fac-
ing each street shall be permitted.
b. There shall not be more than 'two (2) Open
House directional signs per Open House.
2. Area
a. A sign indicating an Open House shall be
subject to the provisions in Article 9.3 -2,2.
b. Open House directional signs shall have no
more than two (2) exposed faces nor have a
gross surface area larger than ten (10)
square feet per face.
3. Location
a. Open House signs shall be located in accord-
ance with Article 9.3 -2,3.
b. Open House directional signs may be located
in the dedicated right -of -way only in
accordance with the provisions below in
Article 9.3 -9,7.
4. Height
a. Open House signs shall be located in accord-
ance with Article 9.3 -2,4.
b. Open House directional signs shall be no
more than 36 inches in height as measured
from the grade at the location of the sign.
5. Times Allowed
Open House signs and Open House directional signs
may only be displayed on Wednesdays from 9 a.m.
to 1 p.m. and on Sundays from 12 noon to 6 p.m.
6. Unusual Conditions
Where unusual conditions on a lot warrant, a
Temporary Use Permit may be obtained, subject to
the provisions in Article 9.3 -1 so as to permit
the placement of a real estate or Open House sign
in a location other than as permitted in Article
9.3 -2,3 and 9.3 -9,3.
7. Special Conditions for Open House Directional
Signs
a. Only two (2) Open House directional signs
shall be permitted on a corner at any time.
If more than (2) signs are placed on a
corner, all signs will be considered to be
in violation of the provisions of the Zoning
Ordinance and subject to confiscation.
b. The placement of Open House directional
signs shall be subject to provisions con-
tained in Chapter 19 of the Municipal Code
pertaining to "view" at corners, inter-
sections, and curb lines.
C. No sign may be placed in the dedicated
right -of -way unless the person wishing to
place the sign agrees in writing to indem-
nify the Village and the abutting property
owner from any and all claims, liabilities,
costs, and expenses of whatever nature aris-
ing directly or indirectly from the place-
ment of said signs in the dedicated
right -of -way prior to so placing the sign."
SECTION That the Village Clerk is hereby directed to publish this
TWO: Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances in conflict herewith
THREE: are, to the extent of such conflict, hereby repealed.
SECTION That this Ordinance shall be in full force and effect from and
FOUR: after its passage, approval and publication, as provided by law.
