O-83-15ORDINANCE NO. 0 -83-15 AN ORDINANCE AMENDING SECTIONS 3 -8, 3 -8A, 3 -9, AND 3 -18A OF ARTICLE ONE OF CHAPTER 3 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 Published in pamphlet form this 16th day of May , 1983, by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0 -83 -15 AN ORDINANCE AMENDING SECTIONS 3 -8, 3 -8A, 3 -9, and 3 -18A OF ARTICLE ONE OF CHAPTER 3 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 3 -8 entitled "Classes of Licenses" of Article 1 ONE: of Chapter 3 of the Municipal Code of the Village of Deerfield of 1975 as amended, be and the same is further amended by adding the following Class BB: ' "Class BB, which shall authorize the retail sale of beer and /or wine in original package not for consump- tion on the premises where sold, provided however, that said license shall permit, subject to the requirements of Section 3 -18A, without the need for additional application, the bona -fide tasting of wines in connection with the sale of wines in their original package." SECTION That Section 3 -8A of Article 1 of Chapter 3 of the Municipal Code TWO: of the Village of Deerfield of 1975, as amended, is hereby amended by striking said Section in its entirety and substituting in lieu thereof the following: "Sec. 3 -8A. Fees. The annual license fees for the various classes of liquor licenses shall be as follows: Class A $1,500.00 Class B 750.00 Class BB 1,000.00 Class C 750.00 Class D 1,500.00 Class D-1 500.00 Class E 2,500.00 Class F, per event 25.00 Wine tasting permits (per special permit) not to exceed 4 per year, available only to Class A and Class B license holders upon proper application 50.00 per wine tasting." SECTION That Section 3 -9 of Article 1 of Chapter 3 of the Municipal Code THREE: of 1975, as amended, is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: "There shall be issued in the Village no more than: Class A Five (5) Class B None (0) Class BB One (1) Class C Two (2) Class D One (1) Class D -1 One (1) Class E `S j X,a (6 )) Class F None (0) licenses to be in effect at one time." SECTION That Section 3 -18A of Article 1 of Chapter 3 of the Municipal FOUR: Code of the Village of Deerfield of 1975, as, amended, is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: "Sec. 3 -18A. Give Away Prohibited. It shall be unlawful for any person to give away or otherwise dispense free of charge, by the drink or in any other manner, within the Village, an alcoholic beverage with the intent of promoting the sales of an alcoholic beverage, except in the case of a Class BB licensee as described in Sec. 3 -8 or, except in the case of a Class A or Class B licensee, upon receipt of a Special Permit as provided in Section 3 -8A hereof. In the foregoing instances giving away wine without charge in small and limited amounts for tasting purposes only, immediately prior and incident to, the sales of wine in the original package for consumption off the premises shall not be considered a violation of this Section. Such permitted give -away, however, shall be subject to the following conditions and limitations: (a) The tasting shall be attended and supervised by a full -time employee and only in a designated area on the licensed premises as approved by the Liquor Commissioner and designated in the license; (b) The actual amount of wine tasted by an indivi- dual may not exceed an ounce, except in the case of a Class BB licensee in which case the actual amount of wine tasted by an individual may not exceed two (2) ounces; (c) The sample shall be served in a container which shall be disposed of following the sampling; and (d) The wine tasting shall not continue past 8:00 P.M. Furthermore, it is hereby declared unlawful to advertise other than by .newspaper publication the availability of "tasting" by posting advertising materials on the premises of any licensee visible outside the licensed premises." SECTION That the Village Clerk is hereby directed to publish this FIVE: Ordinance in pamphlet form. SECTI.ON That all ordinances or parts of ordinances in conflict herewith SIX: are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect from and SEVEN: after its passage, approval and publication as provided by law.
