O-83-23ORDINANCE NO. 0 -83 -23 AN ORDINANCE AUTHORIZING AN IMENDMENT TO A SPECIAL USE - COMMERCIAL AND INDUSTRIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has hereto ;:ire held a public hearing on the application of SVEN FLODSTROM (herein referred to as "Applicant ") to authorize an amendment to Ordinance No. 82 -43 authorizing a Special Use'- Commercial and Industrial Planned Unit Development to provide for the development and use of certain real estate described on Exhibit A hereto and for a Special Use - Planned Unit Development, under and pursuant to- the provisions of Articles 5.2 -3,8, 6.1 -3, 5, 12.1, 12.1 -2, 12.5, 12..8 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commis- sion, the President and Board of Trustees have considered and reviewed the Amended. Final Development Plan of that portion of the Subject Property identi- fied and designated as "Western I -1 PUD ", consisting of an Amended Final Land Use Plan and an Amended Final Landscape Plan for the office portion of the Western I -1 PUD, submitted by applicants in addition to all other documentary filings required by the Zoning Ordinance of the Village of Deerfield reflecting all revisions from the original Final Development Plan which was made a part of Ordinance No. 82 -43; and WHEREAS, The President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Amendment to Special Use- Commercial and Industrial Planned Unit Development in accordance with the Amended Final Development Plan for the Western I -1 PUD marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively ONE: find that the Amended Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Article 13.11 -4 of the Village Zoning Ordinance, and the Amended Special Use of the real estate, as and for purposes of` an Industrial Planned Unit Development as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Amended Special Use TWO: hereby granted is subject to the following condition: That all use, construction and development shall be in accordance with the Amended Final Development Plan, dated June 28, 1983, prepared by Camiros, Ltd., a copy of which is marked Exhibit B and attached hereto and made "a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Devel- opment Procedures as set forth in Article 12.6 of the Village Zoning Ordinance, the terms of this Ordinance and all representations by the Applicant to the Plan Commission and President and Board of Trustees. SECTION That any violation of the condition hereinabove set forth by the THREE: Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION As part of this Ordinance granting the Amended Special Use and FOUR: approving the Amended Final Development Plan, the following modification of the regulations established in the I -1 Office, Research, Restricted Industrial District are hereby authorized, all in accordance with the Amended Final Land Use Plan and the representations of the Applicant: 1. Permit parking in the required side and rear yard setbacks. 2. Elimination of the landscape screening requirement along the western boundary of the office building portion of the Western I -1 PUD. 3. Modification of the landscape screening requirement along the west side of the entry road so as to permit deciduous plant material in lieu of evergreen planting in accordance with the Amended Final Landscape Plan for the Western I -1 PUD. 4. Modification of the landscape screening. requirement along the north boundary of the office building portion of the Western I -1 PUD so a to permit a two foot earthen berm with deciduous plantings not less than three feet in height in lieu of evergreen plant materials in accordance with the Amended Final Landscape Plan for the Western I -1 PUD. SECTION That the Village Clerk is hereby directed to publish this FIVE: Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Amended Final Land Use Plan" In the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That except to the extent specifically amended hereby, all SIX: provisions of Ordinance No. 82 -43 shall remain in full force and effect and all undertakings of the Applicant or its successors, shall remain in full force and effect as if fully restated herein. � I SECTION That this Ordinance shall be in full force and effect from and SEVEN: after its passage, approval and publication, as provided by law.
