ORDINANCE NO. 0-82-49 AN ORDINANCE AUTHORIZING A SPECIAL USE - RESIDENTIAL PLANNED UNIT DEVELOPMENTS WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of JOHN MENNENOH and LILLIAN MARSHALL (herein together referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A hereto for a Special Use - Residential Planned Unit Development, under and pursuant to the provisions of Articles 4.5 -3,8, 12.1, 12.1 =2, 12.2, and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commis- sion, and the Preliminary Development Plan by the President and Board of Trus- tees, the President and Board of Trustees have considered and reviewed the Final Development Plan consisting of a Final Land Use Plan, Final Landscape Plan and Final Site, Utilities and Topography Plan (collectively hereinafter referred to as the "Final Development Plan "), submitted by Applicant in addi- tion to all other documentary filings required by the Zoning Ordinance of the Village of Deerfield reflecting all revisions from the -original Preliminary Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use - Residential Planned Unit Development, in accordance with the Final Development Plan for the Subject Property marked Exhibit B and attached hereto and made a part hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively ONE: find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 12.2 and 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Residential Planned Unit Development as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use hereby TWO: granted is subject to the following conditions: (A) That all use, construction and development shall be in accordance with the Final Development Plan, dated August 10 , 1982, prepared by Rolf Campbell & Associates , a copy of which is marked Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.6 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees, specifically including but not limited to the following: 1. Parking shall be permitted on only one side of the internal private roadways on the real estate. 2. Applicant or its successors, grantees, transferees or assigns shall install a carriage walk on the west side of the internal private roadway on the real estate. 3. Applicant or its successors, grantees, transferees or assigns shall enter into an agreement with the Village whereby all of the Village ordinances and regulations pertaining to public streets, including but not limited to, overnight parking and fire lanes, can be enforced by the Village on the internal private roadways on the real estate. 4. Applicant shall dedicate to the Village that portion of the real estate shown on the. Final Development Plan which is owned by Applicant and used as part of Waukegan Road. SECTION That any violation of any of the conditions hereinabove set forth THREE: by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this FOUR: Ordinance in pamphlet form and to record said Ordinance and that portion of Exhibit B known as the "Final Land Use Plan" in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect from and FIVE: after its passage, approval and publication, as provided by law. Reconsidered and passed over President's veto.
