AN ORDINANCE AMENDING ARTICLES 5 AND 14
OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore
held a public hearing on the application of MCDONALD'S CORPORATION to consider
certain text amendments to the Zoning Ordinance relative to regulations appli-
cable to restaurants with drive - through facilities; and
WHEREAS, said hearing was held pursuant to duly published notice thereof
and was, in all respects, held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after consider-
ing the evidence adduced, made written findings of fact in favor of the
proposed text amendments to the Zoning Ordinance of the Village of Deerfield;
and
WHEREAS, the President and Board of Trustees of the Village of Deerfield
have determined that the recommendation of the Plan Commission will serve the
best interests of the Village of Deerfield.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Article 5.2 -3, 1 d, (2) of the Zoning Ordinance of the
ONE: Village of Deerfield, as amended, be and the same is further
amended by adding thereto the following:
"Drive- through facilities accessory to a free - standing
restaurant which existed as a Special Use prior to the
adoption of the Zoning Ordinance which also has either
direct signalized access to an existing right -of -way
or (a) an Agreement has been executed which fully
provides for the establishment of signalized access
for the location and (b) the Illinois Department of
Transportation has authorized said traffic
signalization."
SECTION That Article 5.2 -7,5 of the Zoning Ordinance of the Village of
TWO: Deerfield, as amended, be and the same is further amended by
deleting said subsection and substituting in lieu thereof the
following:
"No business establishments, except restaurants with
drive - through facilities as permitted in accordance
with Article 5.2 -3, 1 d, (2), automobile service
stations or drive -in bank facilities when authorized
as Special Uses, shall offer goods or services
directly,to customers waiting in parked motor vehicles
or sell beverages or food for consumption off the
premises or on the premises in parked motor vehicles."
SECTION That Article 14 of the Zoning Ordinance of the Village of
THREE: Deerfield, as amended, be and the same is further amended by
adding thereto the following definition: '
"Restaurant Drive - Through Facility -- A use accessory
to a restaurant where food is ordered at a remote
on -site location adjacent to a traffic lane which is
restricted to vehicles utilizing this service and
where, after the order is placed, the vehicle
continues on to a service window to pay for and to
pick up the food ordered."
SECTION That the Village Clerk is hereby directed to publish this
FOUR: Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances in conflict herewith
FIVE: are, to the extent of such conflict, hereby repealed.
SECTION That this Ordinance shall be in full force and effect from and
SIX: after its passage, approval and publication, as provided by law.
