O-82-23ORDINANCE NO. 0 -82- 23 AN ORDINANCE GRANTING A MODIFICATION FROM JHE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 88 S. WAUKEGAN ROAD, DEERBROOK SHOPPING CENTER, DEERFIELD, ILLINOIS WHEREAS, NORTHWEST NATIONAL BANK OF CHICAGO, as Trustee of Trust No. 122 has petitioned for a modification from the strict provisions of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the display of a wall sign on a building wall not housing the use for which the sign is intended; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and the Board of Trustees its written findings of fact and recommendation: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the Zoning ONE: Board of Appeals recommending approval of the petition are concurred in and adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find that unneces- TWO: sary or undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordin- ance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: That part of the North z of Section 4, township 42 North, Range 12, East of the Third P. M., described as follows: Commencing on the North line of said Section 4 and the center line of the state road (Waukegan Road) and running thence West on said North line 793.8 feet; thence Southeasterly parallel to the Easterly line of the right -of -way of the Chicago, Milwaukee,St. Paul and Pacific Rail- road 1174 feet; thence East 813 feet; thence North 32.8 feet to the center of said state road; thence Northwesterly along said center line of state road 1154.4 feet to the place of beginning, in Cook County, Illinois. SECTION That a modification from the strict provisions of Article 9 THREE: of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit the display of a wall sign on a building wall not housing the use for which the sign is intended, all in accordance with the plans presented and filed with the Zoning Board of Appeals, and subject to the further conditions that said modification shall apply only to the Petitioner's signs and not to any successor, assign or future occupant of the above - described property. SECTION That the variation hereby granted is subject to compliance FOUR: by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from FIVE: and after its passage and approval, as provided by law.
