O-82-24ORDINANCE NO. 0 -82- 24. AN ORDINANCE GRANTING A MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1345 LAKE -COOK ROAD, DEERFIELD, ILLINOIS WHEREAS, J. Emil Anderson and Son, Inc. has petitioned for a modification from the strict provisions of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the display of two double -faced non - illuminated real estate signs in lieu of the one permitted, at a height of 13 feet above the curb in lieu of the permitted 10 feet in the case of the sign described in Section Three (a) below, and one sign having a surface area of 200 square feet per face and the other 50 square feet per face, each in lieu of the permitted 20 square feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and the Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the Zoning Board ONE: of Appeals recommending approval of the petition are concurred in and adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find that unnecessary or TWO: undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which- is legally described on Exhibit A attached hereto and made a part hereof. SECTION That a modification from the strict provisions of Article 9 of THREE: the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit the display of the following signs: (a) A non - illuminated square feet in size south side of the Tollway Spur and to configuration with the "V" and with exceed three feet height not to exceec double -faced sign up to 200 per face to be located on the subject property facing the be constructed in a "V" shaped a 30 degree maximum angle in its base at a height not to above grade and its maximum 1 13 feet above grade; and (b) A non - illuminated double -faced sign up to 50 square feet in size per face to be located at approximately the mid -point of the subject property's Lake -Cook Road frontage and to be constructed in a "V" shaped configuration with a 30 degree maximum angle in the "V ". SECTION That the modification hereby granted is subject to compliance by FOUR: the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and FIVE: after its passage and approval, as provided by law.
